A crucial meeting convened in Antwerpen by the European and British Kashmiri activists agreed to expand the ‘Jammu Kashmir national Independence Alliance’ to global level by linking up the activists and organisations in different countries of the world including USA, Canada, Europe, UK, Middle East and ‘back home’, in the state of Kashmir.

The meeting was called by a group of European Kashmiri activists from ‘Azad’ (free) Kashmir, the Pakistani controlled part of the divided Kashmiri state settled in different countries of Europe for some years.

“ I have been actively involved in the struggle for independent Kashmir since my student days and rose to lead the National Student Federation (NSF) before protesting against the restrictions on pro independent Kashmir activists to participate in election and was arrested tortured by the authorities in 1990s. After moving to Belgium I continued my support for independent Kashmir along with the struggle for find work and residence in here.” Says Mr Hassan a garment trader who works long hours to make living in Europe and is determined to play his role in improving the lot of people in all parts of the divided Himalayan state.

Elaborating on the background work for the meeting, Mt Shahid Azam and Shahid Azam Junior, both long-time activists stated that one factor in the lack of success for pro-independence perspective on Kashmir has been the reluctance amongst leadership in speaking the whole truth about Kashmir. It has become a trend amongst the diaspora activists to speak either the Indian or the Pakistani version of the Kashmir story. The time has come for speaking the whole truth that the entire state of Kashmir is occupied and all occupying forces including India, Pakistan and China need to leave Kashmir and let Kashmiri decide their future democratically. To give this voice credibility and power to get to the democratic and diplomatic centres as well as the forces for justice and progress across the world we wanted to connect all like minded Kashmiris across the world.

It was during such discussions that they got connected with the leadership of ‘Jammu Kashmir National Independence Alliance (JKNIA) in existence in Britain for some years with an international agenda. After some telephonic conferences it was decided to call a preliminary conference of the JKNIA leadership and the diaspora activists in other countries of the world. The JKNIA was represented by Mehmood Kashmiri, the chair, Nadeem Aslam , secretary general , Najib Afsar spokesperson, Ghulam Hussain Vice President and Shams Rehman from the Association of British Kashmiris. The Alliance leadership welcoming the desire for an international body and offered detailed background information on the structure and work the alliance has carried so far.

Mehmood Kashmiri, the current chair of the Alliance said that we respect and appreciate each and every individual, organisation or group across the world and inside our divided country of Kashmir who have carried forward the struggle for a democratic independent Kashmir. We want to bring Kashmiris of all regions, religions and languages closer into a political community.

Ghulam Hussain, the vice chair of the alliance said that to avoid reinventing the wheel we think extending the existing alliance to encompass all those striving for united independent democratic Kashmir anywhere is the most effective way forward.

Mr Anwar Khan and Amjad Mehmood called from Dubai and Altaf Makhdoomi from Cyprus to share their desire for an independent international body to promote the cause of independent Kashmir and express best wishes for the efforts to construct such a body.

After some discussions it was agreed to set up an expansion committee that will reach out to activists and organisations in different countries and organise an international convention in order to elect a central leadership by sometime in the middle of 2012. A constitutional committee was also agreed to carryout necessary amendments. The Expansion committee consisted of Mehmood Kashmiri, Nosherwan Hussain, Najib Afsar, Shahid Azam and Shahid Azam Junior. The constitutional committee included Nadeem Aslam, Ghulam Hussain, Hassan Mehmood, Shams Rehman and Nasim Iqbal.

Others who deliberated and supported the efforts for expanding the JKNIA included Sabar Malik, Abid Hussain, Najib Afsar, Mohammed Aziz, Abid Hussain Khan, Tariq Kashar and Muhammed Hussain. It was acknowledged that due to a range of reasons a large number of people who share the purpose could not attend the meeting who the expansion committee will approach and engage in the further development of the Alliance.

In a special session on the following day Mr. Abdul Hamid Khan, chairman of Balawaristan Front and Ateeq Rehman also supported the idea of internationalising the independence alliance and Hamid Khan agreed to work as observer with the Alliance. While highlighting his concerns about the exclusion of Gilgit-Baltistan or Balawaristan people from the ‘Kashmir’ question, Hamid Khan insisted that all regions and citizens of the state share a common purpose of striving for freedom from forced and exploitative occupation.

In the concluding session the following declaration was issued by the existing leadership of the Alliance and the new Committees set up for expansion and constitutional development as the framework for promoting the independence politics.

1. The Alliance recognises, appreciates and willing to work with each and every individual, group, organisation or political party striving for a united independent Kashmir or for the unfettered right of self-determination for all the state subjects;

Alliance views ‘Kashmir’ as the political national identity of the State that was officially known as ‘the State of Jammu and Kashmir and Tibet Ha and Aqsai etc.’ is currently divided under the occupation of India and Pakistan into three ‘Kashmiri governments’ and geographical parts. While China occupies some parts, it does not claim the entire state like India and Pakistan and formally agrees to renegotiate the areas under her occupation with the legitimate authority after the final settlement of the Kashmir question.

3. Covering an area of 85806 sq. miles (2,22236 sq. Kms) Kashmir is a multi-cultural state with Kosher, Sheena, Balti, Dogari, Gojari, Pahari (Ponchi, Mirpuri etc.), Kishtawari, Ladakhi, Broshisky as the major linguistic and cultural identities and Hindu, Sikh, Budh, Christians and Muslims as religious identities of the state subjects. While the Alliance fully recognises and strongly believes in celebrating the cultural and religious diversity of the state, it is committed to resist and fight against any illegal, undemocratic and coercive or suppressive moves to divide and disintegrate the state using all available and legitimate means.

4. All three governments inside the state boundaries while has some features of democratic elections are controlled by the occupying governments of India and Pakistan and are not representatives of their respective regions. The Alliance fully supports all the struggles of all peoples in the jurisdiction of these governments for fully representative and democratic constitutional assemblies and socio-economic developmental and cultural rights.

5. The Alliance also supports the demands for fully representatives and democratically elected regional assemblies in the Jammu and Ladakh regions of the state.

6. The armies and paramilitary forces of India and Pakistan that entered Kashmir in 1947 under the pretext of ‘protecting’ Kashmiris have committed atrocities against the citizens of Kashmir state and are clearly seen as occupying forces by a growing number of Kashmiris in all parts of the state. The Alliance believes that for bringing peace and building democratic and civil politics in the state, the armed and military forces of India and Pakistan should immediately be removed from the populated areas and gradually completely withdrawn from the state as per their pledges in the United Nations.

7. All Political prisoners should be released from all parts of the state including, M Afzal Guru, Baba Jan and the mortal remains of Maqbool Bhatt

8. All administrative and infrastructural hindrances for the trade and movement across the ‘division line’ must be removed and all natural routes connecting different regions of the state be reopened and rebuilt including Jammu Mirpur, Ladakh-Baltistan and Gilgit-Baltistan-‘Azad’ Kashmir.

9. State Subjcet should be issued in card form for all the state subjects for travelling across the state.

10. The struggle in Kashmir and amongst diaspora is not against the people of India-Pakistan or any religion or nation. It is for the emancipation and independence from the forced occupation of Kashmir state of the armed, political and civil occupation of India and Pakistan.

11. The Alliance strongly and firmly believes that the struggle for the independence of Kashmir is directly linked with the struggle of the millions of Indian and Pakistani people for freedom from poverty and underdevelopment. The occupation of Kashmir costs India and Pakistan bulk of their national budgets which they spend on the weapons of mass destruction which leaves little for ‘mass construction’.

12. The Alliance believes that the struggle in Kashmir from its inception in modern popular form in 1930s has primarily been for democracy with Kashmiriyat (coexistence, pluralism) at the core of its political philosophy. Hence it has a direct link with and must be championed by the democratic forces around the world including those in India and Pakistan.

13. The alliance would continue its support for the campaign for the recognition of Kashmiri identity of Diaspora communities in their countries of settlement.

برسلز (پ ر ) برطانیہ اور مختلف یورپی ممالک میں خودمختار کشمیر کی تحریک سے وابستہ کشمیریوں کا انتہائی اہم اور تاریخی اجلاس بیلجم کے شہر انٹورپن میں منعقد ہوا جس میں طویل بات چیت کے بعد فیصلہ کیا گیا کہ دُنیا بھر میں خودمختار کشمیر کے لیے سرگرم کشمیریوں کو کشمیر انڈی پنڈنس آلائنس کے پلیٹ فارم پر یکجا کیا جائے گا۔ پہلے سیشن میں حاضرین کو خوش آمدید کہتے اور اجلاس کی غرض و غایت بیان کرتے ہوئے شاہد اعظم جونئیر، شاید اعظم سینئیر اور حسن بھائی نے بتایا کہ کئی سالوں سے مسلسل جدوجہد اور بے پناہ جانی و مالی قربانیوں کے باوجود ریاست جموں کشمیر کا مقدمہ عالمی سطح پر متعلقہ ادارے اور عوام نہ تو کشمیریوں کے نقطہ نظر سے آگاہ ہیں اور نہ ہی خود مختاری کی جدوجہد کو وہ حمایت اور مقام حاصل ہوسکا ہے جو دُنیا میں آزادی کی دوسری تحریکوں کو ۔ اس کی وجہ پر روشنی ڈالتے ہوئے اُنہوں نے کہا کہ ہم ’’ریاست جموں کشمیر و تبت ہا ‘‘کے باشندے مغربی دُنیا اور مشرق وسطیٰ میں بہت بڑی تعداد میں ہونے کے باوجود ان گنت چھوٹے چھوٹے گروپوں اور ٹولیوں میں بٹے ہوئے ہیں جس کے نتیجے میں ہمارا کام کہیں بھی موثر نہیں ہوپاتا۔ اُنہوں نے کہا اس تناظر میں ہم یورپ ، مشرق وسطیٰ اور امریکہ و کنیڈا وغیرہ میں مقیم دوستوں نے مختلف مواقعوں پر تبادلہ خیال کرتے ہوئے عالمی سطح پر خود مختار کشمیر کی تحریک کو اُجاگر کرنے ، موثر بنانے اور جمہوریت، آزادی، انصاف اور ترقی کی حامی قوتوں کی حمایت حاصل کرنے کے لیے کشمیریوں کے عالمی اتحاد کی ضرورت کو شدت سے محسوس کیا۔ تاہم اس کے لیے کسی نئے اتحاد کے قیام کی بجائے برطانیہ میں کچھ عرصے سے قائم ’’ جموں کشمیر انڈی پنڈنس آلائنس ‘‘ کی قیادت سے کئی ہفتوں تک اس کو عالمی سطح پر متحرک و منظم کرنے کی ضرورت پر تبادلہ خیال کیا گیا اور باہمی صلاح مشورے سے آج کا یہ باضابطہ اجلاس منعقد کیا گیا۔ جموں کشمیر انڈی پنڈنس آلائنس کے پس منظر اور دائرہ کار پر روشنی ڈالنے کے لیے برطانیہ سے اس کے چئیر مین محمود کشمیری، سیکرٹری جنرل ندیم اسلم، وائس چئیرمین غلام حسین ، ترجمان نجیب افسر اور شمس رحمان موجود تھے۔ اُنہوں نے بتایا کہ انڈی پنڈنس آلائنس گو عملی طور پر برطانیہ تک محدود رہا ہے تاہم اس کو عالمی سطح پر متحرک و منظم کرنے کی راہ میں کسی قسم کی کوئی رکاوٹ موجود نہیں۔ اس پر تمام حاضرین نے متفقہ فیصلہ کیا کہ کوئی نیا اتحاد تشکیل دینے کی بجائے اسی اتحاد کو وسعت دی جائے اور دنیا بھر کے مختلف ممالک میں اُن تمام تنظیموں اور افراد کو اسی پلیٹ فارم پر یکجا کیا جائے۔ اس کے لیے آئینی اور انتظامی یا توسیع کمیٹیاں تشکیل دی گئیں ۔آئینی کمیٹی میں ندیم اسلم، شمس رحمان غلام حسین ، حسن محمود اور نسیم اقبال کو نامزد کیا گیا جبکہ توسیع کمیٹی نوشیروان حسین، نجیب افسر،محمود کشمیری، شاہد اعظم اور شاید اعظم جونئیر پر مشتمل ہوگی۔ کمیٹیاں آئندہ چند ماہ میں آلائنس کی وسعت کے لیے درکار آئینی و انتظامی اور انتخابی قوانین و ضوابط اور طریقہ کار طے کرتے ہوئے مرکزی کنونشن کا اہتمام کریں گی جس میں آلائنس کی مرکزی قیادت کا انتخاب کیا جائے گا۔
اجلاس میں مشرق وسطیٰ سے کشمیر نیشنل ایسوسی ایشن کے سردار انور خان اور امجد کیانی اورسائپرس سے الطاف مخدومی نے ٹیلی فون کے ذریعے شرکت کرتے ہوئے بھرپور تعاون کا یقین دلایا ۔ دیگر شرکاء جنہوں نے اظہار خیال کرتے ہوئے عالمی سطح پر آلائنس کی ضرورت و آفادیت سے اتفاق کیا اُن میں صابر ملک، محمد عزیر، عابد حسین خان، طارق کاشراور محمد حسین شامل تھے۔
اجلاس کے دوسرے سیشن میں عتیق الرحمان اور بالاورستان فرنٹ کے عبدالحمید خان نے بھی خصوصی طور پر شرکت کی اور اتحاد سے بھرپور تعاون اور یک جہتی کا اظہار کرتے ہوئے مبصر کی حیثیت سے کام کرنے پر رضامندی کا اظہار کیا۔

اجلاس کی طرف سے جاری کردہ اعلامیے کے مطابق اجلاس کے رہنما اصول جن کی بنیاد پر اور جن کی روشنی میں ریاست جموں کشمیر کی وحدت و خودمختاری اور تمام ریاستی باشندوں کے معاشی، سیاسی، ثقافتی و سماجی حقوق کی جدوجہد کو عالمی سطح پر اُجاگر کیا اور آگے بڑھایا جائے گا اُن میں سے اہم ترین درج ذیل ہیں:

۱۔ اتحادکے رہنماؤں نے منقسم ریاست کے تمام حصوں میں موجود تمام چھوٹی بڑی سیاسی تنظیموں ، گروپوں اور افراد کی طرف سے وطن کی وحدت و قومی آزادی کے لیے کی جانے والے جدوجہد کو سراہتے ہوئے اس بات کو واضح کیا کہ ریاست کہ ریاست کے اندر اور ان تمام قوتوں کو باہمی طور پر قریب لانے اور اتحاد میں شامل کرنے کے لیے مسلسل جدوجہد کی جائے گی ۔
۲۔ کشمیر جس کو قیام کے وقت سرکاری طور پر ’ ’ریاست جموں و کشمیر و تبت ہا اور و اقصائے وغیرہ‘ ‘ کا نام دیا گیا تھا آج تین ریاستی حکومتوں اور جغرافیائی ٹکڑوں میں بٹی ہوئی ہے ۔ کاشری، ڈوگری، گوجری، پہاڑی ( پونچھی، میرپوری ) ، بروشسکی، لداخی، بلتی، کشتواری اورشینااس ریاست کی ثقافی اور سماجی شناختیں ہیں اور ہندو، سکھ ، عیسائی، مسلمان، اور بُدھ اس ریاست کی مذہبی شناختیں ہیں۔ اتحاد ریاست کشمیر کی اس رنگا رنگی کو نہ صرف تسلیم کرتا بلکہ ہر ایک ثقافت اور علاقے کے عوام کے تمام حقوق اور وسائل کو عالمی سطح پر متعارف کروانے اور پروان چڑھانے کے لیے متحرک اور سرگرم جدوجہد کا پر یقین رکھتا ہے ۔
۳۔ ریاست کشمیر 85.000 مربع میل پر مشتمل ایک منفرد تاریخی ،سیاسی اور جغرافیائی وحدت ہے جس پر بھارت وپاکستان ا ور چین نے قبضہ کر رکھا ہے جبکہ بھارت و پاکستان پوری ریاست پر ملکیت کا دعویٰ بھی کرتے ہیں۔آلائنس ریاست کی جبری، غیر آئینی ، غیر قانونی اور غیر جمہوری تقسیم کی ہر ایک کوشش اور سازش کے خلاف بھرپور مزاحمت اور جدوجہد کرے گا۔
۴۔ریاست کے اندر موجود حکومتیں جن میں بھارتی مقبوضہ کشمیر میں ’’ جموں وکشمیر ‘‘ پاکستانی مقبوضہ کشمیر میں ’’ آزاد کشمیر‘‘ اور ’’ گلگت بلتستان ‘‘ کی حکومتیں شامل ہیں ۔ یہ بنیادی انسانی حقوق کے تحفظ اور اس سلسلہ میں کوئی قابل ذکر قانون سازی میں مکمل طور پر ناکام ثابت ہوئی ہیں۔ اتحاد ان تینوں ریاستی حکومتوں کو بااختیاراور جمہوری بنانے اور ان کو نمائندہ حیثیت دیے جانے کے ساتھ ساتھ جموں اور لداخ کے لیے بھی مقامی طور پر بااختیار ، جمہوری اور نمائندہ اسمبلیوں کے قیام کی حمایت کرتا ہے ۔
۵۔ بھارت اور پاکستان کی فوجیں جو کشمیریوں کا تحفظ کرنے کے بہانے ریاست میں داخل ہوئی تھیں مختلف مواقعوں پر ریاستی باشندوں کے خلاف جبر اور ان کے قتل کی مرتکب بھی ہوئی ہیں ۔گذشہ بیس سالوں سے بھارتی فوج نے وادی کاشر میں ہزاروں کشمیریوں کا قتل کیا ہے۔ ہم مطالبہ کرتے ہیں کہ فوری طور پر بھارت و پاکستان ریاست میں آبادیوں سے اپنی فوجیں ہٹائیں اور بتدریج ریاست کی حدود سے نکل جائیں جیسا کہ دونوں نے اقوام متحدہ میں وعدہ کر رکھا ہے۔
۶۔ جنگ بندی لائن کے آر پار موجودہ تجارتی ٹرانسپورٹروں کو پاکستانی کسٹم کی طرف سے تنگ کیے جانے کا سلسلہ فوری بند کیا جائے اور ریاست کے اندر تمام قدرتی راستے کھولنے کے لیے گلگت بلتستان و آزاد کشمیر و لداخ اور جموں و میرپور کو ملانے والی سڑکوں کو سفروتجارت کے لیے تعمیر کیا جائے۔
۷۔ ریاست کے اندر جنگ بندی لائن کے آر پار سفر و تجارت کے لیے باشندہ ریاست کو کارڈ کی شکل میں جاری کیا جائے۔
۸۔ ریاست کے تمام حصوں میں تمام سیاسی قیدیوں کو رہا کیا جائے بشمول مقبول بٹ کا جسد خاکی، افضل گورو اور بابا جان ۔
۹۔ آلائنس کے خیال میں خودمختار کشمیر کی تحریک بھارت یا پاکستان کے عوام یا ان کے مذاہب یا سالمیت کے خلاف ہر گز نہیں بلکہ ریاست میں دونوں ملکوں کے فوجی، سول اور سیاسی و ثقافتی قبضے و تسلط اور ریاستی وسائل کے استحصال سے نجات کے لیے ہے۔
۱۰۔ ہم یقین رکھتے ہیں کہ کشمیر کی قومی آزادی کا مسئلہ صرف کشمیریوں کی آزادی کا سوال نہیں بلکہ یہ بھارت و پاکستان کے عوام کی غریبی و استحصال سے آزادی اور ان کی ترقی کے سوال سے بھی جُڑا ہوا ہے کیونکہ اس وقت بھارت و پاکستان کی حکومتیں اس مسئلے کی وجہ سے قومی بجٹ کا بڑا حصہ تباہ کن ہتھیاروں کی تعمیر و خرید پر صرف کرتی ہیں۔
۱۱۔ ریاست کشمیر میں ۱۹۳۰ کے عشرے سے ہی جدوجہد بنیادی طور پر جمہوریت کے لیے ہے یوں اس کا دنیا میں عوامی جمہوری تحریکوں اور جمہوری قوتوں کے فروغ کی جدوجہد سے بھی گہرا تعلق بنتا ہے۔
۱۲۔ آلائنس بیرون کشمیر تمام ممالک میں آباد کشمیریوں کے کشمیری تشخص کو تسلیم کروانے کی جدوجہداور تارکین وطن کشمیریوں کے نئے وطنوں میں ان کے حقوق و ترقی کی کوششوں میں سرگرمی سے حمایت کرے گا۔

Special Conference on Kashmir on Wednesday 26th October 2011 in Committee Room P at Port Caullis House, House of Commons London from 6pm to 8pm.
Where the Newly Elected Prime minister of Azad Kashmir Ch Abdul Majeed will be present as the Chief Guest.
Organised by Jammu Kashmir Self Determination Movement Europe.

I am writing to you on behalf of the Jammu Kashmir National Independence Alliance (JKNIA) UK in your capacity as a possible invitee to the above mentioned Special Conference at the House Commons at 6-00pm on Wednesday 26th October 2011 to draw your attention to the following issues which are relevant for proper exercise of the Right of Self Determination for the independence of entire Kashmir (including both the Indian Occupied Kashmir and the Pakistan Occupied Kashmir)

1. That any referendum or vote on right of self determination must include an option for a United and completely Independent Kashmir and not just the options for Kashmir being part of India or Pakistan.

2. Any negotiations on the referendum or vote on right of self determinations must include representation from Kashmiri organisations and parties who support the Option of United and completely Independent Kashmir as this view is not represented by the people who are part of the State Government in Indian and Pakistani Occupied Kashmir.

3. As you may be aware and may be able to verify from the Chief Guest who is representing Pakistan Occupied Kashmir at the conference on 26th October as the Prime minister of the Pakistan Occupied Kashmir (Azad Kashmir) represents a Legislative assembly for which people and parties supporting the idea of independent Kashmir are not allowed to take part in the election.In order to qualify as the candidates for the elections for this assembly they have to declare an Oath that they support the annexation of Kashmir to
Pakistan.

As you may be aware JKNIA is an alliance of a number of Political Parties and organisations working for the peaceful resolution of the Kashmir issue through negotiated settlement for complete independence and unification of Kashmir.

We are writing to request you to take into consideration the issues raised above which are supported by many people of Kashmiri origin living in the UK including many who may live in your constituency and kindly consider making your support for right of self determination conditional to the inclusion of the option for united and completely independent Kashmir and asking the Government of Pakistan and Pakistan Occupied Kashmir to lift the ban on the parties which support the option of United and completely independent Kashmir.

On 15th August 1947The British Paramountcy ceased to exist and the sovereignty of the Kashmir state was legally reverted to the people of Kashmir automatically This reversion of sovereignty to the people of Kashmir was in the consequences of the provision 7B of the Indian Independence Act1947.The people of Kashmir had a legal Right of Self-Determination to shape their own destinies by forming their own Government? After 64 years of this conflict between India and Pakistan fought full scale wars and forcibly divided former princely state Jammu Kashmir into four parts Indian Occupied Jammu Kashmir (IOK),Pakistan Occupied Kashmir, (POK), Azad Kashmir, Gigit Baltistan , Aksai Chin (Chinese control areas) Pakistan gifted to China in 1962.We urge to all extend to their full support for United Independent Kashmir, free of military and every sort of weapons. Inclusion of British Kashmiri as a ethnic group in Britain.We would like to draw your attention to the other forms of human rights violation on both sides of the division line in Kashmir. The worse form of the violation is to bar any person or political party from participating in elections, joining employment or issuing any publication without pledging support to state’s accession to Pakistan or the Indian Constitution. These restrictions closes all the doors for peaceful, democratic and civil forms of protest and leave young Kashmiris vulnerable to ‘illegal’ and ‘extreme’ means of expressing their aspirations for independence.
Another rights violation of Kashmiri Diaspora which has roots in Jammu Kashmir but migrated to Britain is the negation and non-recognition of Kashmiri identity in Britain and branding British Kashmiris as Pakistanis or Indians depending which side of the division they come from. It is time that British MPs ask the governments of India and Pakistan to lift undemocratic banns on political participation in democratic process, release all political prisoners, issue state subject in a card form and let all state subjects move freely across the division line, initially all the families that are divided across the division line to be free to see each other without going through years long bureaucratic processes. However, as you can see the issue is primarily a political one and needs political approach to address the issue of military and civil occupation of Jammu Kashmir by India and Pakistan that causes HR violations in Jammu Kashmir. The following measures to resolve the Kashmir Question according the will and wishes of the people of Kashmir:

Withdraw all foreign forces from all parts of Kashmir state;
Release of all political Prisoners including the mortal remains of the leader of national independence and unification movement Mohammed Maqbool Bhatt from Tihar prison Delhi;
Complete freedom of trade and movement across the division line and internationally for all the State Subjects ;
Freedom of Press and Assembly ;
Removal of all restrictions on the politics of independence for free and fair elections in the entire state for regional assemblies and a national assembly;
Making necessary arrangements for Self Determination including and with the right to independence through a fair, free and democratic mechanism.

4th OCTOBER 1947 IS THE BIRTHDAY OF THE PROVISIONAL REPUBLICAN GOVERNMENT OF JAMMU KASHMIR

4th October 1947 is the true birthday of the provisional Republican Government of Kashmir also known as Azad Kashmir Government. The nearest past origin of Republican Government of Kashmir lies in the uprising in Poonch during the year of 1947. the simmering revolt in Poonch erupted into an open resistance in July - August 1947. it sparked of by a series of events and exploded by the British announcement that the two new states. Bharat and Pakistan, in British India were to be created and British imperialism was about to leave India.

In January 1947, assembly elections were conducted in Kashmir. In February, Atlee, the British Prime Minister, announced the British Government's decision to quit India in the very near future. The people of Kashmir suspected that something was going to happen, but no one knew where and how. It happened in Poonch in the spring of 1947. The Raja of Poonch was a tributary to the Maharaja of Kashmir. He was dispossessed of his estates during the Second World War and Maharaja of Kashmir began to collect taxes in Poonch. Both the rulers and the taxes were very harsh and exacting. The people of Poonch defied the law of Maharaja by unleashing a no tax campaign in spring 1947,

Among the 7167 Kashmir! soldiers who served in the Second World War 6402 were from Poonch. The people of Poonch complained against the harsh taxes. There was a tax on every hearth, every window, every wife, every cow, every sheep and every buffalo. Further more, The zaldari tax was imposed to pay the cost of taxation, and Dogra troops were billeted on the people of Poonch to enforce the collection. Maharaja Hari Sing had previously refused to accept these soldiers in his military forces after their demobilization and had sent them back to their farms. At the same time, he had strengthened his garrisons in the areas of Poonch including Mirpur with the Sikhs and Hindu Dogras. The people of Poonch including Mirpur did not take it laying down.

No sooner did the appointed day (15th August 1947) arrive than they set themselves for combing the areas for the establishment of a free zone in south-western part of the Kashmir State. On 15th August 1947, the British Paramountcy ceased to exist and the sovereignty of the Kashmir State was legally reverted to the people of Kashmir automatically. This reversion of sovereignty to the people of Kashmir was in the consequence of the provision 7B of the Indian Independent Act of 1947. Thus, the people of Kashmir had a legal right of self-determination to shape their own destinies by forming their own government.

As a result, the struggle for the liberation and independence of Kashmir accelerated by the uprising in Jammu and Poonch around September-October 1947. it was during this period of struggle that Provisional Republican Government of Kashmir (Azad Kashmir Government) was formed on 4th October 1947. On that day the patriotic members of the Muslim Conference assembled at Paris Hotel in Rawalpindi to form a revolutionary government of Kashmir. After several meetings and long deliberation the draft declaration was eventually finalized. The cabinet of this government consisted of:
Khwaja Ghulam Nabi Gilkar (Anwar)-Presedent
Sardar Mohammad Ibrahim Khan - Prime Minister
Nazir Hussain Shah - Finance Minister
Mr Aleem - Education Minister
Mr. Karkhana - Industry Minister
Mr. Fahim - Agriculture Minister

Muzaffarabad was made as headquarters of the Provisional Republican Government. In this connection another meeting was held at Persian Hotel on 5th October. About 200 Kashmiris participated this meeting and all agreed to the declaration and offered their full support and assistance to the newly born Independent Republican Government of Kashmir.

On 4th and 5th October 1947, Radio Pakistan broadcast the declaration of the Provisional Government repeatedly. The declaration was also published in several newspapers.
The Civil and Military Gazette Lahore of 8th October 1947 writes:
Provisional Republican Government for Kashmir Muslim Conference Leaders Announcement
"A provisional Republican Government has
been set up for Kashmir State with headquarters at
Muzaffarabad in Kashmir territory 20 miles from
Pakistan border, according to the telegram received from
Rawalpindi on Saturday night. The message which is
signed by Mr. Anwar who describes himself as the
President of Provisional Republican Government of
Kashmir state, with the termination of paramountcy of
the Biritsh Crown the ruling family of Kashmir have lost
whatever rights it claimed under the treaty of Amritsar
(1846) under which Kashmir was transferred by the
British to Maharaja Ghulab Singh a forefather of the
present ruler for a paltry sum of rupees 50 lakhs and that
the payment with headquarters at Muzaffarabad.
The people have set up a Provisional Republican
Government

message further states, if after one a.m. on 4th October 1947, Hari Sing the ...(deposed) Maharaja or any person acting under his orders or instructions claims to rule over the state, he shall be punished according to the laws of the Provisional Government Henceforth all laws, orders and instructions promulgated or issued by the Provisional Republican Government of Kashmir State to be respected and obeyed. Mr. Anvvar is a prominent member of Kashmir Muslim Conference, the president of \\liich is Choudhary Ghulam Abbas and the general secretary Agha Shuwkat Ali (who) have been imprisoned for about a year by the (illegal) Kashmir government, (A.P.I)."

The opportunist politicians of Kashmir overthrew this Provisional Republican Government of Kashmir on 24th October 1947, after 20 days of its birth, in the name of its ‘reconstitution’. They succeeded easily because two days after the formation of the Provisional Republican Government, its President Khwaja Ghulam Nabi Gilkar Anwar rushed to Srinagar. His purpose was to form an underground resistance in the support of the Provisional Government, to arrest deposed and illegal ruler Hari Sing, and to warn Shaikh Muhammad Abdullah against the so-called Kashmir's accession to Bharat.

During the first two weeks of October the armed struggle that started by the people from different areas of the state hindered the return of the founder President back to Muzaffarabad. He was eventually arrested in Srinagar and his absence from Muzaffarabad paved the way for the opportunists to succeed in overthrowing Provisional Republican Government of Kashmir and turning it into a puppet government. Today. The opportunist Kashmir! politicians refuse to accept that the Azad Kashmir Government was set up on 4th October 1947. they continue, shamefully, to celebrate 24th October as the birthday of Azad Kashmir Government Where as the declaration issued with the name of reconstitution of Azad Kashmir Government RECOGNISES the legitimacy of the Provisional Republican Government and the formation of its cabinet. The declaration issued in the name of the reconstitution of the Azad Kashmir Government on 24th October 1947 itself cries out loudly about the true birthday of the Provisional Government that can be seen in 'The Pakistan Times1 of Saturday 25lh October 1947.

It states, 'The Provisional Azad Government which the people of Kashmir had set up- a few weeks ago, with the object of ending intolerable Dogra tyrannies and securing to the people of the state, including Muslims, Hindus and Sikhs, the right of the free self-government has now established its rule over a major portion of the state territory and hopes to liberate the remaining pockets of Dogra rule very soon. In view of this circumstance it has been RECONSTITUTED with Mr. Ibrahim Bar - at - law of Poonch as its provisional head, and its headquarters had been moved to Plundri in Poonch. The RECONSTITUTED government was formed on 24th OCTOBER 1947.

its cabinet consisted of Sardar Mohammad Ibrahim Khan - as President, and other ministers Sayed Ali Ahmed, shah Chaudhary Abdullah Khan Bhali, Khwaja Ghulam Din Vani, Sayed Nazir Hussain Shah and Sana Ullah Shamim."

The declaration issued in the name of the 'reconstitution' of the Provisional Azad Government itself admits the formation of Azad Kashmir Government on 4th October 1947 by stating three factual indicators. The first indicator, 'the Provisional Azad Government which the people of Kashmir set up a few weeks ago' — shows the true birthday of Provisional Republican Government. The term 'RECONSTITUTION' is itself an indicator to prove that the Provisional Republican Government on 4th October 1947. Understandably, the reason for not celebrating 4th October as the true birthday of Azad Kashmir Government lies in the final paragraph of the declaration. It says, 'the question of accession of the state Jammu and Kashmir to either DOMINION can only be decided by free vote by the people in the form of referendum'. This, without any doubt, can be regarded as no less than a historical raid against the legitimacy of the Provisional Republican Government of Kashmir set up on 4"' October 1947 and the basis for changing its political programme.

Thus, the course of struggle from 24th October 1947 onward has been diverted from National Independence to accession first to either Dominion and then with the passage of time to Pakistan. After looking at the declaration issued on 24lh October 1947, one should need no other authoritative statement or material to certify that the Provisional Republican Government of Kashmir or Azad Kashmir Government came into being on 4th October 1947.

Dear Mr President,

We, the members of the Jammu Kashmir National Independence Alliance would like to express our deep dismay and disgust in continuation of the Karachi Pact imposed by Government of Pakistan on the people of Gilgit Baltistan on 28 April 1949.

We believe that this forced agreement considered by the citizens of the state of Jammu and Kashmir as an ‘Enslavement Deed’ has continuously deprived the people of Gilgit and Baltistan (the areas of Jammu and Kashmir under direct control of Pakistani Government since 1949) from their fundamental political, economical, self-governance human rights and access to justice.
For the last 62 years the people of Pakistani occupied Gilgit Baltistan and Pakistani Occupied ‘Azad’ Kashmir vehemently protested against this ‘Karachi Pact’ signed under duress by the Intrem Authority of Jammu Kashmir with Government of Pakistan on 28th April 1949.

Therefore, we urge you as President of Pakistan, to take urgent action to halt violation of human rights and Jammu Kashmir state subject rule in Gilgit Baltistan. we would like tom bring to following to your attention which are of deep concerns.

Imposition of Gilgit-Baltistan (Empowerment and Self-governance) order 2009.

The imposition of Gilgit-Baltistan (Empowerment and Self-governance) order 2009 does not meet the constitutional and self-governance needs and aspirations of the people of Gilgit Baltistan. In our view this is another attempt of Government of Pakistan to annex these parts of the State of Jammu Kashmir as a de-facto 5th province of Pakistan.

Jammu Kashmir National Independence Alliance (JKNIA) calls for a fully democratic and accountable constitutional assembly with complete self-governance legislative powers in Gilgit Baltistan and transfer of all powers to the citizens of the State of Jammu and Kashmir in Gilgit Baltistan which are currently held by Ministry of Kashmir Affairs, Government of Pakistan by virtue of ‘Karachi Pact’.

Restore and respect the Jammu Kashmir state subject rule of 20th April, 1927 in all matters relevant to discharge of your government’s responsibilities under United Nations Commission for India and Pakistan (UNCIP) resolutions within the jurisdiction of Gilgit and Baltistan.

Facilitate and respect the right of all the citizens of the State of Jammu Kashmir to free movement and trade within, between and across all parts of the state of Jammu Kashmir (Gilgit Baltistan POGB, ‘Azad’ Jammu Kashmir POK and Indian administered Jammu Kashmir IOK).

Arbitrary Arrests and attack on Civil Society in Gilgit Baltistan

Restoration of democratic rights and genuine development require the existence of civil society and freedom of speech that is able to operate freely without fear, intimidation or attack. The current situation for civil society groups and indigenous political organisations is dire and requires urgent attention. Reports we have received from our members and partners in Gilgit Baltistan are deeply disturbing, with hundreds of members of civil society and local indigenous political parties reported detained without fair judicial trial, many in unknown locations.

Jammu Kashmir National Independence Alliance (JKNIA) calls for the release of all those detained without charge. In addition, we reiterate that, under international law, civil society and indigenous political parties in Gilgit Baltistan must be allowed to operate freely without intimidation or attack and that all the fundamental rights of the citizens of the Jammu Kashmir State in Gilgit Baltistan according to UNCIP resolutions and other international covenants that Pakistan is signatory of must be restored and respected without further delay.

Restrictions on freedom of expression

We have noted your efforts in recent years to increase political space and freedom in Pakistan but it is particularly disappointing to witness the reversal of this in Gilgit Baltistan and ‘Azad’ Jammu Kashmir, evidenced by the arbitrary arrests of indigenous political parties’ activists, threats of detention of journalists, as well as arrests, raids on local newspapers and printing presses, the prevention of publication, and new regulations for print and broadcast media. Such actions stifle free expression, violate human rights and destroy your recent record on advancing democracy.

JKNIA calls for freedom of speech and movement within and between Gilgit Baltistan and Azad Jammu Kashmir, including the repeal of ‘Karachi Pact’, release of all political activists detained, and that radio, print, television and electronic media be allowed to operate freely.

Actions have purported to maintain law and order, but in reality the targets have so far been the, civil society and indigenous political activists, the media and all voices of independent and democratic dissent. For the promotion of the well-being of all the citizens of the State of Jammu Kashmir currently living under direct control of Pakistan in Gilgit Baltistan or in Pakistan administered ‘Azad’ Jammu Kashmir, these communities must be supported, not stifled. We appeal to you to immediately reverse recent actions that undermine democracy, freedom and fundamental rights; and instead act in the interest of people and support the vital work being conducted by civil society in Gilgit Baltistan (POGB)and ‘Azad’ Jammu Kashmir (POK).

Pakistan retained control of the following subjects

1. Defence
2. Foreign policy’ of POK

The POK government was saddled with overseeing

1. The policy with regard to administration

2. General supervision of administration, and

3. Publicity of its own activities. The charter of the Muslim Conference was restricted to publicity on the plebiscite and ‘general guidance of the POK government’. The Karachi Pact was a landmark in that it sought to institutionalize Kashmiri subservience to Pakistan and put POK in its place.

Last 62 years people of Gilgit Baltistan (POGB) and (POK) ‘Azad’ Kashmir constantly protested against the Karachi Pact 28th April 1949 and demanded for this authoritarian and colonial like agreement to be abolished and replaced with an equal, fair, democratic and empowering governance system which controls by state subject holders of the state of Jammu Kashmir.

To support the people of Gilgit Baltistan (POGB) .Creation of a De facto fifth Pakistani Province Gilgit Baltistan via Empowerment and Self-governance order 2009.Unfair rigged election and discriminatory laws which only support to the foreign elements and set up of a status quo. In this context the JKNIA members parties fully endorse and support the demands made by the people of Gilgit Baltistan (POGB) and Azad Kashmir (POK).

بروز جمعرات مورخہ 10 مارچ 2011 کو بی بی سی ریڈیوں ایشین نیٹ ورک پرایک بجے بعد دوپہر نیہال (Nihal) کے پروگرام میں عنقریب شروع ہونیوالی مردم شماری (census) کے فارموں میں برطانیہ میں آباد کشمیریوں اور سکھوں کی جداگانہ قومیتی شناخت کو تسلیم کروانے کے مطالبات پر ایک دلچسپ اور معلوماتی بحث ہوئی ہے ۔ تقریباً ایک گھنٹے کے اس پروگرام میں ایسوسی ایشن آف برٹش کشمیری کے راہنما شفق حسین نے برطانوی کشمیریوں کی نمائندگی کرتے ہوئے یہ دعویٰ کیا ہے کہ برطانیہ میں مردم شماری کرانے کا ذمہ دار ادارہ آفس فار نیشنل سٹیٹیسٹک(Office for National Statistics) برطانوی کشمیریوں کے خلاف امتیازی رویہ اختیار کئے ہوئے ہے ۔شفق حسین نے اپنے اس دعوے کی تائید میں یہ ایک ٹھوس دلیل پیش کی ہے کہ گزشتہ 2001 کی مردم شماری کے دوران صرف دوہزار خانہ بدوشوں نے اپنے لئے جپسی (Gypsy) شناخت ظاہر کی تو موجودہ 2011 کی مردم شماری میں اُن کی جداگانہ شناخت کو تسلیم کرلیا گیا ہے جبکہ تہیس ہزار (23,000) سے زائد کشمیریوں نے اپنی قومیتی شناخت ’’کشمیری ‘‘ ظاہر کی ہے مگر کشمیریوں کی جداگانہ شناخت کو تسلیم نہیں کیاگیا ۔
سفق حسین کے موقف پر پروگرام میں شامل آفس فار نیشنل سٹیٹیسٹک کے نمائندے نے یہ نہایت ہی بھونڈی قسم کی دلیل پیش کی ہے کہ برطانیہ میں آباد کشمیریوں کی اکثریت اپنے آپ کو پاکستانی سمجھتی ہے اس لئے کشمیریوں کی جداگانہ شناخت کو تسلیم کرنے اور ان کے لئے الگ خانہ رکھنے کی ضرورت نہیں ہے ۔ اس طرح برطانیہ کا آفس فار نیشنل سٹیٹیسٹک اصل میں برطانوی کشمیریوں کی قومیتی شناخت کے ایک جمہوری و جائز مطالبے اور برطانوی معاشرے کے ایک اہم مسئلے کو کشمیر کی جبری تقسیم اور اس پر بھارت اور پاکستان کے جبری قبضے کی سیاست کے ساتھ نتھی کرکے اسے پیچیدہ بنانے کی کوشش کررہا ہے جس سے کشمیریوں کے خلاف برطانوی حکمرانوں کے تاریخی نوعیت کے جرائم کا پنڈورا بکس کھُل سکتا ہے ۔
برطانیہ میں اپنی جداگانہ قومی کشمیری شناخت تسلیم کروانے کا کشمیریوں کا مقصد سردست مردم شماری کے مقاصد کے ساتھ جڑا ہوا ہے جوکہ خالصتاً برطانیہ کے کثیر الثقافتی معاشرے کا ایک اہم مسئلہ ہے ۔مردم شماری کا ایک بنیادی مقصد برطانیہ میں آباد مختلف قومیتوں جنہیں عام طور پر مختلف کمیونٹیز بھی کہا جاتا ہے ،کی مختلف ضرورتوں کا اندازہ لگا کر انہیں پورا کرنا ہوتا ہے۔ان میں روزگار، صحت ، رہائش ، تعلیم اورمادری زبان جیسے اہم مسائل شامل ہوتے ہیں ۔ ایک عام اندازے کے مطابق اس وقت چھ لاکھ سے زائد کشمیری برطانیہ میں آباد ہیں جوکہ برطانیہ کے کثیر الثقافتی معاشرے کا ایک اہم اور نہایت موثر جُز ہے ۔مگر مردم شماری کے فارموں میں کشمیریوں کے لئے الگ خانہ نہ ہونے کے باعث یہ معلوم کرنا ممکن نہیں ہے کہ برطانیہ میں آباد دوسری کمیونٹیز کے مقابلے میں روزگار، صحت ، رہائش ، تعلیم وغیرہ میں کشمیری کمیونٹی کس مقام پر اور کہاں کھڑی ہے ۔
ایک عام خیال کے مطابق برطانیہ میں آباد دوسری کمیونٹیز کے مقابلے میں کشمیری کمیونٹی کی نوجوان نسل میں بے روزگاری اور جرائم کا رحجان زیادہ اور تعلیم کا رحجان بہت کم ہے اور یہ تاثر عام پایا جاتاہے کہ منشیات اور اس سے متعلق جرائم میں ملوث کشمیریوں کی نئی نسل کا تناسب دوسری کمیونٹیز کے مقابلے میں زیادہ ہے اور آبادی کے تناسب کے لحاظ سے برطانیہ کی جیلوں میں بند کشمیری نوجوانوں کی تعداد زیادہ ہے ۔یہ خیالات اور تاثرات کس حد تک حقائق پر مبنی ہیں ان کا صیح اندازہ اعداد وشمار کی عدم موجودگی میں لگانا کسی طرح ممکن نہیں ہے اور اگر یہ خیالات اور تاثرات برطانوی معاشرے کے حقائق ہیں تو پھر تحقیقات کرکے ان کے اسباب کا کھوج لگانے اور انہیں دور کرنے کی ذمہ داری حکومت اور کمیونٹی کی خدمات انجام دینے والے سرکاری اداروں پر عائد ہوتی ہے ۔
اگر برطانوی کشمیریوں کو اپنی کمیونٹی کی فلاح وبہود اور اپنی نئی نسل کے بارے میں کوئی تشویش لاحق ہے اور وہ ان مسائل کو سمجھنے اور ان کو دور کرنے کاکوئی ارادہ رکھتی ہے تو اس کا صیح طریقہ کار صرف یہی ہے کہ برطانوی کشمیریوں کے ثقافتی مسائل کو بھارتی اور پاکستانی کمیونٹیز کے مسائل کے ساتھ گڈ مڈ کرکے انہیں اعداوشمار کے ہندسوں کے نیچے دبانے کی کوشش نہ کی جائے بلکہ کی جداگانہ قومی شناخت کو تسلیم کیا جائے اور برطانیہ میں آباد دوسری کمیونٹیز کی طرح کشمیری کمیونٹی کے بارے میں بھی روزگار، صحت ، رہائش اور تعلیم کی موجودہ صورت حال کے اصل اعداد وشمار کو سامنے لایا جائے اور کشمیریوں کی شکایات کاازالہ کیا جائے ۔جب سے برطانوی کشمیریوں نے یہ ادراک حاصل کیا ہے کہ اُن کی جداگانہ قومی شناخت کو تسلیم کئے بغیر برطانیہ میں کشمیری کمیونٹی کے حقوق کا موثر دفاع اور اس کی فلاح بہبودکا موثر کام ممکن نہیں ہے اُس وقت سے کشمیریوں کی جداگانہ شناخت کو تسلیم کروانے کی جدوجہد جاری ہے ۔شروع میں برطانیہ میں ایسی کشمیری تنظیموں اور گروپوں کا قیام عمل میں لایا گیا جو کشمیر کی سیاسی پارٹیوں کے اندرونی مسائل کے مقابلے میں برطانوی کشمیریوں کے مسائل میں زیادہ دلچسپی لیتے تھے اور تحریک آزادی کشمیر میں اپنے کردار کو صرف سفارتی اور سیاسی محاذ تک محدود رکھنا چاہتے تھے ۔ان برطانوی کشمیری تنظیموں اور گروپوں نے کشمیریوں کی جداگانہ قومی شناخت کو تسلیم کرانے کی جدوجہد کا آغاز کیا اور اس جدوجہد میں کچھ کشمیری انفرادی طور پر بھی شامل تھے لیکن کشمیریوں کی جداگانہ شناخت کو تسلیم کروانے کی جدوجہد کرنے والے ان گروپوں و تنظیموں اور انفرادی کشمیریوں کے درمیان کوئی کوآرڈی نیشن موجود نہ تھی ۔اپنے اپنے طور طریقے سے جدوجہد کرنے والی ان تنظیموں میں سے ایک کشمیری ورکرز ایسوسی ایشن بھی تھی ۔
1998 ء میں کشمیری ورکرز ایسوسی ایشن(برطانیہ) کے چیئر مین شفق حسین نے جو اب ایسوسی ایشن آف برٹش کشمیری کے ساتھ وابستہ ہیں، کشمیریوں کی جداگانہ شناخت کو تسلیم کروانے کے لئے مردم شماری کے ذمہ دار ادارے آفس فار نیشنل سٹیتیسٹک ، ممبران پارلیمنٹ اور مختلف مقامی کونسلوں کو ایک خط لکھاجس پر مردم شماری کے ڈائریکٹر گراھم سی جونز (Graham C Jones) اور ممبران پارلیمنٹ میں سے راجرگاڈسف (Roger Godsif) ، ٹونی بن(Tony Ben) اور ولیم ھیگ(William Hague) نے مثبت اور حوصلہ افزا جوابات دیے ۔اس دوران بریڈ فورڈ اور اس کے ارگرد رہنے والے شمال کے کشمیری بھی کشمیریوں کی جداگانہ شناخت کو تسلیم کروانے کا کام کررہے تھے ۔لہذامورخہ 20 ؍ جنوری 1999 ء کو مختلف کشمیری جماعتوں ، گروپوں اور شہروں کے کشمیری نمائندوں کی ایک کانفرنس بریڈ فورڈ میں بلائی گئی جس میں کشمیریوں کی جداگانہ قومی شناخت کو تسلیم کروانے کے لئے قومی سطح پر تحریک چلانے کا فیصلہ کیا گیا او راس مقصد کے لئے کشمیر قومی شناخت مہم(Kashmir National Identity Campaign) کا قیام عمل میں لایا گیا اور معروف کشمیری تریابی (پہاڑی) زبان کے قلمکار علی عدالت کو اس مہم کا کوآرڈی نیٹر منتخب کیا گیا۔
علی عدالت کے سچے جذبے ، سخت محنت اور اپنے ساتھیوں کے ساتھ مخلصانہ رویے اور بہت سے کشمیریوں کی مدد سے بارہ (12) سال کے عرصے میں کشمیر قومی شناخت مہم ایک ایسے مرحلے پرپہنچ چکی ہے جہاں اب نہ تو اس کی واپسی کا کوئی راستہ ہے اور نہ ہی اس کے رُک جانے کا کوئی امکان۔البتہ مردم شماری کے ذمہ دار برطانوی ادارے نے اگر کشمیریوں کے خلاف اپنا موجودہ امتیازی رویہ جاری رکھا تو یہ تنازعہ کشمیر پیدا کرنے میں برطانیہ کے مجرمانہ کردار کو بے نقاب کا ایک سبب بھی بن سکتا ہے کیونکہ اپنی جداگانہ قومی شناخت کو تسلیم کرانے کی یہ تحریک چند برطانوی کشمیریوں کا مسئلہ نہیں بلکہ یہ برطانیہ میں آباد کشمیری کمیونٹی کے بنیادی حقوق کا ایک سوال ہے ۔
علی عدالت کے مطابق برطانیہ کی اٹھارہ مقامی کونسلوں نے کشمیریوں کی جداگانہ شناخت کو تسلیم کرلیاہے ۔مورخہ 17 تا 23 مئی 2008 ء کے دی نیشن لندن کے مطابق کم ازکم انچاس (49) ممبران پارلیمنٹ نے ہرلی ڈے موشن (Early Day Motion) پر اپنے اپنے دستخط کرکے کشمیریوں کی جداگانہ شناخت کی حمایت کی ہے جن میں سے دو کا تعلق ٹوری ، ایک کا انڈی پنڈنٹ ٹوری، چھتیس کا لیبر ،چھ کا لبرل ڈیموکریٹک،ایک کا سکاٹش نیشنل پارٹی اور ایک کا سوشل ڈیموکریٹک اینڈ لیبر پارٹی سے ہے ۔برصغیر ہندوستان کے مختلف ممالک سے تعلق رکھنے والوں اور خاص کر کشمیریوں اور پاکستانیوں کے لئے یہ بات دلچسپی سے خالی نہ ہوگی کہ اس ہرلی ڈے موشن پر دستخط کرنے والوں میں کشمیریوں کے حق خود ارادیت کی حمایت کا دعویٰ کرنے والے کسی کشمیری یا پاکستانی رکن پارلیمنٹ کانام نہیں ہے جبکہ لیسٹر سے بھارت نژاد رکن پارلیمنٹ کیتھ واز اور بریڈ فورڈ سے رکن پارلیمنت مارشا سنگھ نے ہرلی ڈے موشن پر اپنے اپنے دستخط کرکے کشمیریوں کی جداگانہ شناخت کو تسلیم کرنے کے مطالبے کی حمایت کی ہے ۔(باقی آئندہ)

JKNAP UK held a Party meeting in Birmingham, Mr. Ikram Mir presided the meeting and a large members of the JKNAP UK board members participated in it.The main agenda was the JKNAP UK organisational issues.The JKNAP UK passed the resolution in complete confidence on the ICJKNAP spokesperson Nadim Aslam and President JKNAP UK Ikram Mir ,Vice President Zaheer Ghori,Organisor Asghir Malik ,General Sectrary Shahid hashmi,Deputy General Sectrary Wahid Ahmed , Joint Sectrary Sardar Zamir, Finance Sectrary Qaiser Khokher ,Organisor North England Shafiq Inqalibi, and Organisor Mid-land Ali Shan Chaudary.

In the resolution, JKNAP UK also condemned any conspiracy against the JKNAP UK board. JKNAP UK is a constitutionally elected body through the democratic process of convention. We are cleared that JKNAP is a socialist revolutionary organisation which believes the current economic structure of the state has totally failed to provide the basic necessities of life to the common person. The current system to run the state is totally based on corruption, oppression and to keep the control on peoples mind and impose the ruler through different unfair means, JKNAP’s manifesto is straight and clear, to destroy the current corrupt system and build the revolution against the occupied authorities.

JKNAP UK is also aware of the fake and bogus political asylum cases in the name of party regarding the freedom struggle of Kashmir. JKNAP UK executive committee took initiative to document the JKNAP UK’s membership. However, to stop the non party, or non state element to file the fake cases in the name of party (JKNAP UK) then JKNAP executive committee also took the action against these culprit elements which involves any business deals regarding the bogus and fake Asylum claim on the name of party.

At the end of meeting a review was taken about the increasing number of members jointing the party, and the upcoming Kashmir conference in London. Two committees were also formed( audit committee and Publicity Board committee).

We the undersigned leaders of Jammu Kashmir National Independence Alliance (JKNIA)
representing different Kashmiri parties amongst the British Kashmiri diaspora are here to
remind you through this memorandum that 63 years ago on this 27th day of October troops
of your country were illegally airlifted into Srinagar, the summer capital Jammu Kashmir and
are since in occupation and have caused death and destruction in our divided country.

While your government justifies the presence of troops in Kashmir on the grounds that the
then ruler of Kashmir signed an instrument of accession with your country which is a claim not
only challenged by us the State Subjects of Jammu Kashmir but is also contested by several
academic scholars of international repute. Even if we oversight the disputed nature of the
accession instrument your country still do not have any legitimate basis for your troops in our country.

With this regard we would like to draw your attention to the following statements by the
founding Prime Minister of your country and an internationally respected leader who was also
the head of Indian National Congress, the very party you are currently representing as the
Prime Minister of India, Mr Juwar Lal Nehru.

"We have declared that the fate of Kashmir is ultimately to be decided by the people.
That pledge weHave given not only to the people of Kashmir but to the world. We will not and cannot back out of it.
We are anxious not to finalise anything in a moment of crisis and without the fullest
opportunity to beGiven to the people of Kashmir to have their say, it is for them
ultimately to decide.

" (Jawaharlal Nehru broadcast to nation - All India Radio, 2 Nov. 1947).

"We have given our pledge to the people of Kashmir and subsequently to the United Nations. We
Stood by it and we stand by it today. ~let the people of Kashmir decide." (Jawaharlal Nehru
Statement in the Indian Parliament, 12 Feb. 1951).

"We have taken the issue to United Nations and we have given our word of honour for a peaceful Solution. As a great nation we cannot go back on it. We have left the
question for final solution to the
People of Kashmir and we are determined to abide by their decision and conscience.

As you can see from the dates of these statements they were issued well after the so called accession and were not only given to the people of Kashmir but to the world. We remind you once again the pledges made by your first Prime Minister and demand your government to play your part in the resolution of Kashmir question according to the historical pledges you as a country made and the aspirations of Kashmiri people across the division line that divides our country under the occupation of your troops and our other neighbour Pakistan. The immediate steps we demand from you include:
1.Complete cessation of military and paramilitary action by Indian forces against the people of Jammu Kashmir;

2. Removal of all bunkers, watch towers and barricades set up by the Indian military and paramilitary forces in towns and villages;

3. Unconditional release of all those imprisoned in connection with resistance to the Indian occupation;

4. Immediate revocation of all the draconian laws;

This must be followed by the following long term measures to resolve the Kashmir Question according the will and wishes of the people of Kashmir:

1.
Withdraw all foreign forces from all parts of Kashmir state;
2.
Release of all political Prisoners including the mortal remains of the leader of national independence and unification movement Mohammed Maqbool Bhatt from Tihar prison Delhi;
3.
Complete freedom of trade and movement across the division line and internationally for all the State Subjects ;
4.
Freedom of Press and Assembly ;
5.
Removal of all restrictions on the politics of independence for free and fair elections in the entire state for regional assemblies and a national assembly;
6.
Making necessary arrangements for Self Determination including and with the right to independence through a fair, free and democratic mechanism.

Memorandum presented to the Pakistani Consulate on 22nd October 2010 regarding the invasion of Pakistani Tribes and regular forces in and subsequent occupation and division of Kashmir on 22nd October 1947.
Your Excellency
We the undersigned member parties of the Kashmir National Independence Alliance based in United Kingdom would like to remind you on this 22nd day of October 2010 that 63 years ago the tribal forces from your country invaded the borders and boundaries of our country apparently to ‘save’ our ancestors from non-Muslim government and population of Kashmir. However, as it turned out to be, the tribal invasion not only forced Maharaja of Kashmir to accede India but also led to the first war between India and Pakistan over Kashmir that rendered Kashmir divided and occupied. Throughout these years Kashmiris across the division line continued their struggle for reunification and independence.
Meanwhile the Indian government took the case to United Nations where several resolutions passed, especially the resolution passed on 13th August 1948, asking your government to withdraw your armed forces and other Pakistani nationals entered Kashmir for the purpose of fighting before India would withdraw the bulk of her forces following a referendum through which Kashmiris will decide the future status of their country.
Till this day you have failed to withdraw your forces from Kashmir. Instead you have strengthened your occupation by setting up Kashmir Council, Kashmir Ministry and the institution of lent officers through which your government exploit the resources of Kashmir and control the part under your occupation. You have also abolished the State Subject in Gilgit and Baltistan.
Through this memorandum we demand your government to take necessary steps on her part to:

1.
Withdraw all foreign forces from all parts of Kashmir state;
2.
Free all political Prisoners;
3.
Grant freedom of trade and movement across the division line for all the State Subjects including Gilgit and Baltistan;
4.
Freedom of Press and Assembly ;
5.
Lift all restrictions on the politics of independence for free and fair elections in the entire state for regional assemblies and a national assembly;
6.
Self Determination including and with the right to independence through a fair, free and democratic mechanism.

Alliance of LIBERALS & DEMOCRAT'S FOR EUROPE has organized a seminar on Kashmir with the Subject “KASHMIR THE FULL TRUTH” hosted by ALDE MEP`s CHRIS DAVIES, 1 IVO VAJGL .The Seminar has started at 12.45 pm. Mr. Chris Davies (MEP UK ALDE), Mr Ivo VAJGL (MEP ALDE Slovenia) has presented the introduction of the seminar along with their comments on Kashmir dispute. In the seminar Speakers were Majeed Trambo ( Pakistan Kashmir centre Brussels ) , Attique Khan ( so called P.M of POK) , Ambassador of Pakistan , MS Shireen Mazari editor of the Nation Pakistan newspaper , General Ashok Mehta former General of Indian ARMY .

In the seminar there was a special invitation to Jammu Kashmir National Awami Party JK NAP Belgium,In the seminar delegation led and presented by following comrades of JKNAP Belgium, Hassan Bhai , M. Shahid Khan . During the presentation in the seminar , the pro Pakistan groups except Ms Shireen Mazari try hard to focus only on the human rights violations of Indian Occupied Kashmir IOK, demanded the (CONDITIONAL) plebiscite for the Kashmiri nation under the UN resolutions which leads the Kashmir only for the accession of Pakistan - India & from the Pro Indian Side Mr. General Ashok Mehta tried to defend the Indians role in IOK , rejected the allegations made by the pro Pakistan groups , demanded to Pakistan to resolve the Kashmir issue under the Shimla agreement (Only bilaterally), he also mention that during the Muasahraf rule India - Pakistan were near to RESOLVE the Kashmir issue , Aim of both countries were to agreed on Soft Border Control, Demilitarization , Joint control on Kashmir , Little autonomy to both Occupied parts of Kashmir . Ms Shireen Mazari has argued that the future of Kashmir will be solving according to the wishes and aspiration of Kashmiri people.

After listening the both parties in the seminar the delegation of JKNAP has argued & divert the attention of Chris Davies MEP , IVO Vajgl MEP that the speakers from India, IOK, Pakistan , POK, has pleaded the case for sake of their own national interest, these stories has no connection with the real situation in Occupied ,Divided, Jammu Kashmir and common man don’t have any benefit with the huge presentation of military and weapons in the region , these are the ruling elites of India & Pakistan , they are trying to bring the Kashmir issue in this seminar for the interest of India & Pakistan.

Kashmiri people do not believe in the UN resolutions, the resolutions which do not give right of freedom to the Kashmiri nation.Kashmiri people will never believe on any four point agenda imposed by India - Pakistan. The straight track to solve the Kashmir problem with wishes of Kashmiri people. In result of that diplomacy Kashmiri nation should get their fundamental rights. India - Pakistan should quit their Armies from Kashmir. These ruling elites who are enjoying the status in all parts of Kashmir are not the real representatives of the Kashmir nation.

Only possible solution for Kashmir is United, Independent state of Jammu Kashmir. On way back from the seminar, the JKNAP Belgium branch, organized a meeting and the delegation presented their report to the party officials. In the meeting all JKNAP Belgium activists endorsed their full support to the delegation of JKNAP Belgium who attended the Seminar.

JKNAP UK held an important meeting in Luton on 26th of September 2010. Mr.Ikram Mir presided the meeting and all the members of the JKNAP UK board participated in it.The death anniversary of Fahim Akram was hosted by JKNSF Comrades UK Then a senior party member delivered a speech and therefore the proper UK full board meeting started.

Firstly, Mr. Asghar Malik presented a resolution to dismiss Mr. Sajjad Raja from the JKNAP UK due to his suspicious activities and his destructive role within the organization. All the board members including working Council and the zonal organizers passed the resolution unanimously to dismiss Mr. Sajjad Raja from the JKNAP UK Permanently and ban Sajjad Raja for any organizational designation from unlimited period.

Secondly, The full board meeting also gave a chance to Mr. Nadim Aslam to justify the allegations against him regarding the party financial matters. Mr. Nadim Aslam presented a detailed report regarding UK party finance. After the presentation, all the board members were completely satisfied from Mr. Nadim Aslam.The board declared that it was all the conspiracy from Mr. Sajad Raja just to create the disturbance within the party.

Thirdly, A full JKNAP UK decided to announced the JKNAP UK convention on the 11th of February 2011 in Luton.The convening committee will form in next meeting in December 2010 in Birmingham..

Fourthly, JKNAP UK condemns any act taken against the party discipline in anyway. After the dismissal of Mr. Sajjad Raja, anybody who deal with Mr. Sajjad Raja as a JKNAP UK member .The party will not be responsible of any type of his deal.

The acting president of JKNAP UK threw the role of comrades who should be united against any conspiracy against the party. A few culprits wanted to break the party structure and destroy the party but JKNAP UK comrades always fought against these black sheep which are more dangerous then anti – revolutionaries. These reactionary forces always try to divert the revolutionary working class struggle to their personal interest. Finally, vice president Zaheer Ghori thanked all the board members for participating in this important meeting.

A DECISION OF JKNAP UK
Sunday (Birmingham) JKNAP UK meeting held in Birmingham on 18 Jul. 2010.All the Board members participated in the meeting. A comrade Nadim Aslam presented a charge sheet against the JKNAP UK President Sajad Raja .After full consideration of the charges against Mr. Sajad Raja , All the participant board members passed a resolution unanimously. The resolution declared no confidence of Sajad Raja as a president.

There were strong allegations against Sajad Raja. The UK board members decided MR. Sajad Raja is no longer the president of JKNAP UK anymore. The acting President is MR. Ikram Mir (ex. Senier vice president) .The board imposed a ban on Mr. Sajad Raja not to act on the behalf of JKNAP UK on any platform.

The board formed a disciplinary committee which consists of five board members. The committee gives the right to Mr. Sajad Raja to justify his actions and the allegations until 19th September 2010.The charge sheet has been sent to Mr. Sajad Raja and all the board members as well.

Rasheed Khan suspended from JKNAP

After a detail meeting and consultation with Senior party officials , The Senior Vice President Jammu Kashmir National Awami Party A.D Chaudary issued a statement with immediate effect.

The Senior Vice President Jammu Kashmir National Awami Party A.D Chaudary suspended a basic membership of Mr.Rashid Khan due to issuing a unauthorised statement on behalf of NC JKNAP.Only party official is authorised to issue such kind of policy statements on behalf of National Council JKNAP.

He has been issued various statements in the past without the consent and approval of the party officials.He is been under investigated and warned many times to do not act as a conspirator in the party ranks.He leaked very important documents in the hands of those elements they are working for the vested interests of India and Pakistan.

One of declared Indian Agent is a close relative of Mr.Rasheed Khan and he is spying for him in the ranks and files of JKNAP.

His basic membership suspended for one year until the full investigation will be completed.During his suspension period Mr.Rasheed Khan do not act, use any means of communication on behalf of JKNAP which harm party and integrity of the party members and leaders.

After this statement if he (Rasheed Khan) is keep trying to create such kind of conspiracy it will be understood that his is permanently terminated from JKNAP.

A.D Chaudry advised to Mr.Nadeem Aslam that he is a founding member of the party and he will continue his great work on behalf of JKNAP any where in the world, false statement of Mr.Rashid Khan doesn't effect your rights as a founding party member.

Senior Vice President JKNAP announced a disciplinary committee who will investigate this matter that who`s else is involve in this conspiracy against party interests,and will be dealt according to our procedures.The disciplinary committee consists on Ejaz Nazir Advocate ex.Gen.Sec.JKNAP, Arshad Malik Advocate member NC JKNAP,Sardar Niaz ex.Gen.Sec and member NC JKNAP.

Sunday (Birmingham) JKNAP UK meeting held in Birmingham on 18 Jul. 2010.All the Board members participated in the meeting. A comrade Nadim Aslam presented a charge sheet against the JKNAP UK President Sajad Raja .After full consideration of the charges against Mr. Sajad Raja , All the participant board members passed a resolution unanimously. The resolution declared no confidence of Sajad Raja as a president.

There were strong allegations against Sajad Raja. The UK board members decided MR. Sajad Raja is no longer the president of JKNAP UK anymore. The acting President is MR. Ikram Mir (ex. Senier vice president) .The board imposed a ban on Mr. Sajad Raja not to act on the behalf of JKNAP UK on any platform.

The board formed a disciplinary committee which consists of five board members. The committee gives the right to Mr. Sajad Raja to justify his actions and the allegations until 19th September 2010.The charge sheet has been sent to Mr. Sajad Raja and all the board members as well.

Kashmiris to held protests in UK against atrocities in Kashmir Valley

Delegations of British Kashmiri diaspora organisations from across Britain are gathering outside the Birmingham consulate of India to echo the slogans raised for many weeks in Srinagar, the capital of the Indian occupied part of divided Kashmir state. Go Go India Go Back Leave our Kashmir is the most popular demand made in continues protests organised by the Kashmiri youth across the valley of Kashmir where at least a dozen young people are killed by the Indian troops to suppress the resistance movement that was erupted in late 1980s and after years of militant clashes with the Indian soldiers has recently turned into relatively peaceful mass demonstrations against the rights violations by the Indian army men.

Since the Kashmiri diaspora in Britain is predominately made up of the Kashmiris from Pakistan I occupied Kashmir, the slogans will also likely to include Go Go Paksitan Go back Leave our Kashmir. The Protest is organised by the British based Kashmir National Independence Alliance (KNIA), an umbrella body of pro independence Kashmiri organisations in UK.

Condemning the killings of unarmed youth in the Indian occupied Kashmir Valley, Mr Mehmood Kashmiri, the chairperson of KNIA said “we understand that there is a large British population of Indian and Pakistani origin and occupation of Kashmir by the armies of two South Asian nuclear powers remains a major impediment in bringing the British South Asian communities closer. However, we would make it clear for our fellow British citizens of Indian origin that British Kashmiris’ protest in Birmingham is not against India as a country or the Indian citizens anywhere in the world but against the illegal occupation and killings by the Indian forces in Kashmir. At the same time we are not against Pakistan or Pakistanis but the occupation and suppression by the Pakistani forces in Kashmir. We would welcome to work with the British Indians and British Pakistanis to end occupation in Kashmir and for peace, progress and democracy in the whole of South Asia.”

Mr Nadeem Aslam, the secretary general of the Alliance speaking on this occasion claimed that root cause of all violence in Kashmir is the occupation of India and Pakistan. Not only that this occupation of Kashmir and arm race between India and Pakistan means that millions of Indians and Pakistanis are forced to live below the poverty line. India and Pakistan should end their occupation of Kashmir and let Kashmir be an independent country friends with both neighbours and sharing resources and opportunities for peace and development.”

The Birmingham organiser and secretary of Association British Kashmiris Mr Safdar Mir said that there are serious concerns amongst British Kashmiris about the ongoing occupation and division of and killings in Kashmir. Right now it is the generation of Kashmiri youth who born and grown up under the guns of Indian forces and militants and is trying to carry on liberation struggle through peaceful and democratic means but the Indian forces are using brutal means to crush the youth mostly in their teens and early twenties.”

The protest will begin at 2:30 on Friday 23rd July and is expected to joined by over a hundred delegates and activists from across Britain. If situation is not improved in Kashmir it is higly likely that more such protests will be organised outside of Indian Embassy in London and in downing street for asking British government to play their role and stopping the killings and playing their role in resolution of this Issue that is seen by majority of Kashmiris as a legacy of British colonial rule.

We the undersigned member parties of the Jammu Kashmir National Independence Alliance (JKNIA) based in United Kingdom would like to remind you on this 28th day of April 2010 that 61 years ago on this day your government imposed a so called agreement on the Kashmiri state subjects in Gilgit Baltistan regions of the State. We believe that this forced and one sided document which people of the state describe as the ‘enslavement deed’, deprived the people of the Kashmir state under Pakistani occupation of several basic political, economic, judicial, constitutional and cultural rights protection of which was the responsibility of Pakistani government under the United Nations resolutions on Kashmir.
For 61 years people of Gilgit Baltistan and ‘Azad’ Kashmir constantly protested against the Karachi Pact 28th April 1949 and demanded for this authoritarian and colonial like agreement to be abolished and replaced with an equal, fair, democratic and empowering governance system.
To support the people of Gilgit Baltistan in general and Gilgit Baltsitan Democratic Alliance (GBDA) in particular several top leaders of All Parties National Alliance (APNA), Jammu Kashmir National Awami Party (JKNAP) and Jammu Kashmir National Liberation Front (JKNLF) went to Gilgit Baltistan but have been arrested. We strongly condemn this action of the authorities and demand their immediate release and any action in future to suppress the peaceful and democratic activities by the people for their rights to be refrained.
In this context the members we fully endorse and support the following demands made by the people of Gilgit Baltistan:

1.Fully democratise the existing set up in Gilgit Baltistan by transferring legislative, judicial and economic powers to the local bodies;

2.Abolish the Kashmir Ministry and Kashmir Council;

3.Lift any restrictions on the independence politics in Pakistani Occupied ‘Azad’ Kashmir and Gilgit Baltistan;

4.Restore and respect the state subject rule in all government appointments and dealings regarding the sale and ownership of any property or the resources within the jurisdiction of State Subject legislation;

5.Withdraw all the armed forces from all parts of the princely state;

6.Accept and respect the right of All Kashmir State Subjects to free movement and trade in all parts of the state including Gilgit Baltistan ;

We would like to ask your good offices to convey our feelings and demands to your government in Islamabad hoping that the government of Pakistan there will take all necessary actions in its powers to give rights to the peoples of Kashmir under her occupation and refrain from Rights violations in these areas of the Kashmir State.

I would like to thank Baroness Emma Nicholson for providing me with the opportunity to elaborate on the De-facto annexation of Gilgit Baltistan done by the government of Pakistan on 29 August 2009,via Gilgit-Baltistan Empowerment and Self Governance Order 2009’ which replaced the earlier ‘Northern Areas’ Legal Framework Order 1994’.

It is not the first time that the government of Pakistan has imposed unilaterally self governance order 2009 ,and withdrawn from its international, bilateral ,regional and national obligations which she made in united nations security council (UNSC) and bilateral treaties between India-Pakistan and her own constitution of 1973.

There is only one article 257 of constitution of 1973 Islamic Republic of Pakistan`s related to Jammu Kashmir.

Article 257 relating to the State of Jammu Kashmir provides as follows:

“When the people of the State of Jammu and Kashmir decide to accede to Pakistan, the relationship between Pakistan and that State shall be determined in accordance with the wishes of the people of that State.”

The result of ceasefire between India and Pakistan on 1st January 1949 .The 29' 814 square miles area of Gilgit Baltistan came under control of Pakistan.

In October 1962 there was a war between India and China. The peoples Republic of China occupied the area of 8' 616 square miles in the North Eastern parts of Ladakh, and area of 5'55 square miles South Eastern area of Dam Choke in Ladakh which are the integral parts of state of Jammu Kashmir.

On 3rd March 1963 Sino- Pakistan Frontier Agreement,The Trans - Karakoram Tract is an area of nearly 2' 239 square miles that was transferred by a border agreement from the (Ch.M.Aslam) Pakistani administered Northern Areas to Peoples republic of China in 1963 with the proviso (section-6) that the settlement was subject to the final solution of the state of Jammu Kashmir dispute.

On 29 August 2009,Via ‘Gilgit-Baltistan Empowerment and Self Governance Order 2009 ,the government of Pakistan unilaterally annexed Pakistan occupied Gilgit Baltistan (POGB) as its de-facto fifth province. Pakistan has withdrawn from her international and regional, obligations which she made to comply with the free will of the people of the Pakistan occupied (POK) areas and for the regional peace and security.

Gilgit-Baltistan Empowerment and Self Governance Order 2009 only proved by the federal cabinet of government of Pakistan and announced by the by the Prime minister and signed by the president of Pakistan as a final authority.

Proposed de-facto Pakistani fifth province of Pakistan occupied Gilgit Baltistan has no constitutional cover from its own constitution of 1973 and neither does it comply with article 257.

GB legislative assembly and council have 55 subjects for making laws out of 61.

The territory of (POGB) shall be proposed under Article 2(f) described territory of Pakistan which is still not approved by Pakistani Parliament (Assembly and Senate) with two third majority.

The rest of the articles are imposed on POGB are part of 1973 constitution of Pakistan and POGB is historically a part of Jammu Kashmir .

These are the other articles of 1973 from constitution of Pakistan which do not apply to POGB.

Mr Qumar Zaman Kaira a Punjabi MNA and KANA minister turned into an ad hoc Governor of POGB with all authority and administrative powers and recent appointment of a new Governor of Gilgit Baltistan ( POGB), Dr,Shama Khalid ,both do not comply with the Jammu Kashmir state subject definition of 20th April 1927.

According to the self governance order 2009 Legislative assembly have directly elected 24 members, besides six women and three technocrats seats.

Under this so-called Self Governance Order 2009 a drama was staged in the name of the Legislative Assembly election to misguide the international community, whereas the indigenous political groups and state subject holders are banned freely to move and participate in these elections.

All of Pakistani political parties show their strength to the local population with the help of Pakistani military and civilian administration and defeated them with their colonial attitude.

The only political alliance of Indigenous local people is Gilgit Baltistan Democratic Alliance (GBDA) who were ousted from the election by force,registered forge cases against its leadership,deported them and put them behind the bars. Every ruling party in Islamabad is always the winner in POGB, because of its control on all administrative and financial sources from Islamabad Pakistan. The inter services intelligence ( ISI) and other secret military agencies have a final authority on all state affairs, and their authority is above the law in the name of national security.

To understand the massive rigging in the election ,Opposition leader Chaudhry Nisar Ali Khan while speaking on a point of order said PPP had won but Pakistan and democracy had been defeated in Gilgit-Baltistan polls. Government indulged in massive rigging in the elections, Government made a mockery of charter of democracy and people of Gilgit and Baltistan, he added. Baitul Mal was misused mercilessly during the polls,he charged. Opposition has staged token walk out from National Assembly.

Marvi Memon a PML,MNA and election in-charge of POGB. Issued a report on November 14, 2009 ,Title-GB elections rigging.

A- Pre-poll rigging, issued a 10 point pre-poll rigging evidence.

B- Poll day rigging,issued a 23 point poll day rigging evidence.

C- 23 observations of The Free and Fair Election Network (FAFEN). Exposed the credibility of a free and fair election in 2009.

The areas of POGB are full of wealth and natural resources and Pakistani military and civil authorities don't want to empower local people because of its rich resources.

As an example Pakistan is one of the fourth largest gemstone exporters in the world, apart from Swat valley the remaining areas of gemstone mining are all in the POGB & POK.

Pakistan is building a Diameer Basha Dam to cover her electricity shortfall in POGB even local people are opposing it and it has capacity to generate electricity approximately 4,500 MW.

According to the Newspaper The Nation 22th October 1991,The Pakistani federal minister of water and power Jam Yousaf stated on the floor of the Pakistan national assembly that, apart from Basha Dam Government of Pakistan will going to build 15 new Dams in the State of Jammu Kashmir, 9 of them are in the Pakistan Occupied Gilgit Baltistan:

1-Bonji Dam ,

2-Rakhoot Dam,

3-yolorelbo Dam,

4-Sakrdoo Dam,

5-Yogo Dam,

6-Tungas Dam,

7-Kanch Dam,

8-Sherquila Dam,

9-Satpara Dam,

Six of the Dams are in the Azad Kashmir (Pakistan Occupied Kashmir -POK).

The UNCIP unanimously adopted this Resolution on 13-August-1948.
Resolves to submit simultaneously to the Governments of India and Pakistan.
Members of the Commission: Argentina. Belgium, Columbia, Czechoslovakia and U.S.A.

Part III of the above mentioned resolution.

The Government of India and the Government of Pakistan reaffirm their wish that the future status of the State of Jammu Kashmir shall be determined in accordance with the will of the people and to that end, upon acceptance of the Truce Agreement both Governments agree to enter into consultations with the Commission to determine fair and equitable conditions whereby such free expression will be assured.

On the basis of historical, legal and constitutional facts we out-rightly reject Pakistani constitutional and colonial aggression on Gilgit-Baltistan in the name of Empowerment and Self-governance Order, 2009.

We demand to the Government of Pakistan to fulfil its obligations towards its occupied areas of POGB and POK. Which she signed in UNCIP resolutions and bilateral treaties with India.

We demand that Pakistan must stop creating a new de-facto fifth Pakistani province of GB because this creation of a new province is an act of occupation of the part of Jammu Kashmir which Pakistan controls since 1947.

This creation of new province is against the wishes and free will of masses and is against all political norms, moral values and legal obligations.

Pakistan's act is contradictory for the Kashmiries and International community. Pakistan fails to perform its trust obligations towards the people of its occupied areas.

We believe that historically Gigit-Baltistan is an integral part of the state of Jammu Kashmir.

We demand from Pakistan to withdraw her armed forces and civil servants from parts of Jammu Kashmir under her occupation (POGB-POK ).

We urge the international community to stop Pakistan exploiting our natural resources and stop building of new dams in the areas of Kashmir because of its disputed nature.

We also demand the return of our million's of dollars foreign exchange collected by Pakistan and handing over by the control of Mangla Dam to the government of Pakistani Occupied Kashmir.

The people of Jammu Kashmir will not accept any forced geographical division of their motherland Jammu Kashmir.

Both India and Pakistan are nuclear states and they have fought wars (including proxy war) against each other in the past. They have spent millions of dollars on military purposes which effects the daily life of common people, those that are living below the poverty line and are millions in number. It's good for the both countries to solve their conflicts through peaceful means, and deliver basic needs of life to their own people rather than spending huge money for military purposes.
Only a Secular, Unified and Independent Kashmir is the way forward for the regional development, security and peace in South East Asia and world at large.

International Council Jammu Kashmir National Awami party ( IC JK NAP) leaders have condemned the state brutalities in Mirpur and Rawalakot city. Local people have been demanding electricity shortage and protested against WAPDA authorities. It is highly condemnable act that Pakistani state has been looting POK resources since its occupation but when our people have demanded nothing but only no load shedding and they met police brutality. It is only place where under Pakistani occupation where little demands of even electricity has been considered sin. We have seen people have been doing the same thing all over Pakistani cities but they have no problems at they can go violent but our peaceful citizen have been brutalized by state police to please Pakistani state authorities. Kashmiris under Pakistani occupation have lost every thing even right of protest against injustices too.

IC JK NAP demanding that POK Govt immediately take over the Mangla dam and declares it state property without wasting any time. Mangla was constructed in our ancestral graves, old Mirpur city was completely drown in to dam water, neither people have been compensated yet after 42 years nor provided any electricity to our POK cities and towns from this dam. POK Govt must announce immediately Mangla dam as its state property and providing electricity to POK region extra electricity can sell to Punjab Govt on market rates. As we all know that Maharaja Hari Singh used to get money from Punjab Govt from rivers and other natural resources and British Govt used to pay for water. POK Govt must immediately take one more step, Make Pakistani Givt to pay its previous balances from Mangla dam since 42 years in full amount according to its own market rates which WAPDA(Water and Power Development Authority Pakistan)
has been charging from our people. Mangla dam is our state property no matter what Pakistani state says. We need our money after construction expenses of the dam, other remaining balance must be immediately paid. If POK Govt is unable to demand all this then immediately step down. As long as we do not have our representative Govt in POK we must demand that first we need our real Govt which can be elected by local people not Islamabad. Islamabad has has been imposed over us a colonial administration and people do not accept it because this POK Govt has been badly failed to even protect our peaceful citizen. Pakistani state secret agencies do not even trust our police and local authorities at all that is why in Mirpur they called in Punjab constabulary. What happened in Rawalakot city is only an act of pleasing Pakistani authorities. We demand that all those involved in brutalities must be immediately suspended and investigation must hold by local High court judge. We demand POK Govt must take up necessary steps to resolve this electricity issue with local people.

Re:

The issue of an occupation of Jammu Kashmir, violation of Human rights, and the threat to the regional peace in South East Asia in the future.

I am writing to you on behalf of Jammu Kashmir National Independence Alliance(JKNIA) which is an alliance of Kashmiri political organisations in the UK working for the peaceful settlement of the Kashmir issue to achieve a united, independent,secular and democratic Jammu Kashmir for all the people of Jammu Kashmir.

You may already be aware of the occupation of Kashmir issue. This directly affects approximately 700,000 people of Kashmiri origin who are citizens of UK and would like to see a resolution of the long standing Kashmir issue.There are currently over half a million Indian forces in Indian Occupied Kashmir and there is constant violation of human rights including torture, abductions, rape of women, murder of innocent Kashmiri men, women and children.

The so called government institutions in both the Indian occupied Kashmir (IOK) and Pakistan Occupied Kashmir (POK) are serving the political interests of their respective masters in India and Pakistan, without regard to the views of the ordinary citizens of Jammu Kashmir. [For example Pakistan Government has recently annexed Gilgit Baltistan (as a de-facto Pakistani province) which is historically an integral part of Jammu Kashmir.] As a consequence there is a deprivation in infrastructure and a huge lack of resources for health facilities, education and employment for the people of Jammu Kashmir which affects them deeply and causes suffering on a daily basis.

Without going into the detail or history of the issue (which some of you will be fully aware of) we are writing to you at this important point in time before the General Election in 2010. At this important time the UK citizens of Jammu Kashmir origin will participate in the elections and may be able to influence the outcome of elections in some constituencies throughout the UK. We should be obliged if you would address the following points in particular:

As an individual candidate please clarify your position on the resolution of the Kashmir issue leading to the creation of a unified, independent and democratic Jammu and Kashmir.

The position of your Political Party in this respect

How you and your party in your respective roles regardless of whether or not you win would help the Kashmiris in the UK and JKNIA in particular to advance the core cause for resolution of this very important issue.

No doubt you will be aware that until and unless this issue is resolved there is a grave danger to peace in this region and to the World at large. As both nuclear powers India and Pakistan continue to regard this as a territorial dispute for their own interests and ignore the views of the people of Jammu Kashmir. Jammu Kashmir National Awami Party (JK NAP) president Liaqat Hayyat condemned state terrorism in Gilgit baltistan area of Chilass and announced that Feb 23rd would be a protest day in all over POK cities, towns and villages under the banner of JK NAP. JK NAP president said that Pakistani security forces have killed 2 innocent people and injured 12, some of them are in very critical conditions. People of the area were protesting over the building of Basha dam in their area and demanding that they must be compensated before they made homeless as Pakistani state has done to the people of Mangla dam affectees and never compensated them since 4 decades. JK NAP leaders have stunned over the killing of Basha dam affectees, who were protesting over the injustices have done to them by govt of Pakistan. It is not surprising for us, as people of Pakistani occupied Kashmir have long time been experiencing these injustices in their own area where Govt of Pakistan and its secret agencies have been established their own secret Govt and people have been treated like colonized people. JK NAP leaders are protesting over these brutal killings of innocent people of Chilass. JK NAP completely supports the demands of local people of Gilgit Baltistan and urges Govt of Pakistan do not build Basha dam as long as this territory is disputed and Pakistan has not been allowed to build any thing on this internationally recognized area of Jammu Kashmir state. Pakistani security forces have opened fire on the peaceful protesters, what a democracy and empowerment plan has been given to the people of Gilgit Baltistan by this Govt, even people of this area can not protest against injustices going on with them. JK NAP will take out processions, protest marches and public rallies all over POK to make people of this area aware what has been going on to the people of Gilgit Baltistan. We both are the victims of the same enemy and have been occupied by the same country and our struggle is one and we never let people of Gilgit Baltistan alone in this national liberation struggle. JK NAP president demanded that those who have been killed by the firing of security forces in Chilass during protest rally must be compensated by pakistani state not what Pakistani state is ready to give them but what ever is the demand of the Basha dam action committee. JK NAP supports Basha dam action committee and demands that affectees must be paid 10 lakh Rupees not what Govt has suggested 5 lakh Rupees.

Meanwhile, International Council JK NAP leaders have also condemned the brutal killings of peaceful protesters in Chilass. Maqbool Bhat and Kashmir liberation movement

It was 11th, February 1984 when Indian Government had hanged Baqbool Bhat in Tharr Jail New Delhi. He was accused of overthrowing Indian occupied Kashmir state Government and he had launched an armed struggle against Indian occupation. It was somehow true that Maqbool Bhat believed in armed struggle and he did launch armed movement on the Indian Side of the Kashmir valley. Maqbool Bhat twice crossed over the LOC and started armed rebellion against Indian state. Maqbool Bhat was determined that Kashmiris must be granted their right of self determination, as Indian and Pakistani states had promised in front of International forums such as United Nations. Kashmiris had waited 15 to 20 years and that time they did believe that Indian and Pakistani states would be able to up hold their commitments they had made with Kashmiri people . First there was Tashkand agreement without consultation of Kashmiri people. It was enough for conscious Kashmiri leaders like Maqbool Bhat to know the intentions of Both occupied Indian and Pakistani states. Maqbool Bhat launched an armed movement to blow up the so called agreement between the two countries. How Kashmiris could had been accepted this kind of agreement which ignores the real aspirations of Kashmiri people both side of the LOC.

Armed struggle in Kashmir was due to failure of Indian and Pakistani rulers to resolve the Kashmir disputed which was created by British imperialist Government while leaving the region. Indian and Pakistani ruling classes had completely cooperated with their colonial masters and helped them securing their political and economical interests in the Indian subcontinent. Irony is that Indian National Congress and Muslim league both creations of British masters conspired with millions of masses and divided this five hundred years old society in the name of reactionary religious politics. It was Mohandas Karam Chand Gandhi who introduced religious politics in colonial India which ended with the division of the country. Indian National congress and Muslim league leaders had been aware of this British conspiracy of dividing the country and they all the way cooperated with British masters. Most of the League and Congress leaders were trained by British and they had schooling in the British educational institutions, where they learned the political tactics from their colonial masters and used them against their own people. After leaving Indian subcontinent, British handed over the power to their puppet Indian leaders. Indian leaders both Congress and league completely failed to delivered what they had claimed before British left Indian subcontinent. These leaders had divided the country on the behalf of British and they did not solve even a single problem after getting so called freedom from British colony. Indian and Pakistani ruler have been adopted the same attitude towards their own people and regional nationalities what British used to do with them. Oppressive state apparatus has been in place since 1947, regional aspirations have been suppressed by British trained armies both side of the border. Civilian bureaucracy have not been changed at all, only white skinned person has gone and his place has been taken over by the brown person but brown person has been more prejudice, more discriminatory, more hypocrite and more brutal than their colonial masters. Pakistani and Indian militaries had been established by British to fulfil the needs of colonial rulers and they were trained to suppress their own people and quell rebellions against colonial rule.

Indian and Pakistani armies had given the same mission in Kashmir to suppress the local aspirations and quell the rebellions against their established colonial rule in Kashmir. Kashmiris had rejected Indian and Pakistani rule in day one. It was known to everyone that Kashmiris have never been accepted Indian and Pakistani occupation. Both countries have been adopted the policy of deception and tried to crush Kashmiris National aspirations but they have been failed again and again. Maqbool Bhat and his comrades had begun this armed movement after both countries refused to accept their own commitments and disregarded their own made promises to Kashmiris. It was the high time for Kashmiris to rebel against Indian and Pakistani ruling classes. Indian and Pakistani states have been following anti Kashmir policy and agreed upon that Kashmiri would not get freedom at any cost and both countries have seen unleashed their brutal forces and made Kashmir a battlefield since 1947. Kashmiris have been deprived of their national democratic rights. Indian armed forces have made Kashmir valley complete bloodbath since two decades. Indian state brutalities have been reached on its peak since the outbreak of armed rebellion in Kashmir valley. Indian state machinery has used all its inhuman tactics to quell the mass rebellion in the valley but failed to suppress the movement completely. Unfortunately, Kashmiri leaders of this movement from valley have not been able to lead this mass movement since the outbreak of this mass rebellion. This mass movement has been leaderless and directionless but common Kashmiri has been thriving for complete freedom which he has been dreaming of since so long and deserves it. Kashmiri leaders have also been failed to come up with the real program of national liberation from both occupied countries. Leadership from has been so confused of leading Kashmir liberation movement and most of them do not know what their liberation would be like nor they are able to convince other regions of Kashmir, in terms of bringing them in this main stream mass movement to liberate the entire state of Jammu Kashmir. They have not badly failed to give a call for total liberation of their people but failed to expel brutal Indian state forces from valley nor have they been able to come up with bargaining position with Indian state since so much blood has been spell in the valley. All leading political parties have been claiming that they are the real freedom fighters but none has been declaring its political program. Most of these valley based political groups have been heavily depending on the Pakistani state secret agencies that have been busy promoting their own agenda and causing so much confusion among common masses. It has been very unfortunate state of affairs that valley based leadership is still not ready to give up proxy politics of the regions two neighbouring countries, even both have been playing politics with Kashmiri masses and made them suffer more.

Maqbool Bhat had a dream of liberating entire state of Jammu Kashmir but those who have been claiming his followers have given up his mission and declared only valley is entire Kashmir. Maqbool Bhat was very determining Kashmiri leader that is why he was eliminated by Indian state. Most the Kashmiri people have been raising question that how Maqbool Bhat was allowed to cross over the LOC, not once but many times without the help of Pakistani state authorities or Indian state authorities. Maqbool Bhat once was elected member of Azad Kashmir legislative but he came to know that this assembly is not real representative of Kashmiri people from this side of the LOC. Maqbool Bhat had looked for all other possible ways out to liberate Kashmir but he could not find any short cut to do all this to help his suppress people. He was completely disappointed from Azad Kashmir assembly which was nothing but forum for a few Pakistani puppets who always trying to please their master in Islamabad. Maqbol Bhat gave up parliamentary struggle and started looking for new way out to liberate his country which has been not only occupied but also forcibly divided by her occupiers. He accepted this great challenge and made a plan to launch a Guerrilla struggle but he used live this side of the LOC . He managed to cross over the divided land of Kashmir and started organizing Kashmiris from Indian side to prepare them to rebel against Indian state. He got help from any occupied authority or not but both state authorities used haunt him like mad dogs. He mission was very much clear on his mind that is why Indian authorities declared him real threat to their occupation. He had courage to challenge the occupied forces both side of LOC and that was later cost his life. He was not confused, he knew very well what his mission is and how he would complete it. Maqbool Bhat was from Indian side of Kashmir and his family members still live in Kashmir that is why he had launched his armed rebellion in that part of Kashmir. Azad Kashmir was not ready to launch an armed struggle nor there was any possibility to liberate this area of Kashmir first, as Pakistani state grip was so strong over this part of Kashmir. Maqbool Bhat knew that it would be easier to launch this armed movement where people were ready to accept it, unfortunately, Maqbool Bhat was soon arrested by Indian authorities and his armed movement was disrupted in the beginning. After long imprisonment Maqbool Bhat was hanged by Indian state on 11th February, 1984. One louder Kashmiri voice was silence in Teharr Jail Delhi but only 5 years later entire valley rebelled against Indian state. Unfortunately, Maqbool Bhat,s dream has not been fulfilled yet because of leadership failure in Kashmir but millions of his fellow Kashmiris have already joined his mission of national liberation of his dream land Kashmir. We hope, sooner or later his awakening Nation would be able to complete his dream of freedom which was dearest to him, even dear than his life.

Maqbool Bhat has completed one precious mission and that was awakening his Nation both side of the divide. It is very true and we all have to confess that If Maqbool Bhat had not sacrificed his precious life for this Kashmir national liberation movement, most of us would not have been part of this movement. I personally got involved this movement after the death of Maqbool Bhat and his death had changed my entire soul just like other millions of Kashmiri youth. Those who have been taken his path and followed him giving their lives to this liberation movement we equally honour them and their struggle for the salvation of our nation. Maqbool Bhat had given his life at the time nobody would had ever thought of it because his nation had gone to long sleep but he knew how to waken them up. Now both side of the LOC no matter what we have been claiming of this struggle but first foundation was laid down by Maqbool Bhat and he was the one who built confidence in our national consciousness both side of the divide. Now there are millions of Kashmiris who have not been only taken up his mission but believe that Independence of Kashmir would be an honourable solution of Kashmir dispute. Maqbool Bhat has also created self confidence among Kashmiri youth and they have taken on Indian military might. Maqbool Bhat is undisputed leader of Kashmiri nation both side of the LOC, even those who abused him during his life and called him Indian agent, some called him Pakistani agent, now accept him as national hero. We Kashmiris never forget Maqbool Bhat,s contribution to his enslaved nation and follow his path to complete his mission of national liberation.

Muzfarabad (POK),January 19 (Scoop News)- International Council Jammu Kashmir National Awami Party ( IC JKNAP) leaders are demanding that Pakistani state must immediately move out its troops from populated areas of POK as soon as possible, after series of suicide attempts have been made on them.

In a statement issued by International Council JK NAP. to press said that It is quiet clear that army has split in groups and fighting has been broke out among army groups and we do not want this hostile army to stay here in our peaceful region to harm our innocent people who are already victims of this occupied army. We demand that in first phase army should immediately relocate and second phase Pakistan army can leave this part of Kashmir, as soon as local Kashmir army could be restored and takes over the responsibilities of the region. Azad Kashmir army must be immediately restored without wasting any more time. It is the need of time and Pakistani army has completely failed to get even a little support from local population nor local people have accepted this army as their own. International Council JK NAP has long time ago predicted that Pakistani army and its secret agencies have been preparing ground for launching an assault on Nationalist movement that is why we have seen a series of suicide bombing in POK cities. It is an attempt to dislodge the local groups which are not ready to accept Pakistani version of Kashmir solution and JK NAP and JK NSF have been on the hit list of ISI and army establishment because they have refused to accept Indian and Pakistani secret dialog in the name of so called composite dialog and track 2 diplomacy.
Statement said, Pakistani army,s presence in POK has neither been safe for them nor for our local population any more. Pakistani army has created terrorist menace in the region and imported in to the POK area and we do not accept it no matter what Pakistani army is trying to show to local people. It is highly condemnable that this terrorist business has injected in to our area. It is related to Pakistani army no one owns this business except Pak army. Unfortunately, Pakistani army has created these inhuman, ruthless religious terrorist groups and using it against political forces and now army,s pro religious group has been using these groups against each other. These terrorists are sponsored by army and we condemn this ruthless secret state policy against innocent people of Pakistan and now Kashmiris are the victims of this ruthlessness. If Pakistani army is not safe in POK and itself has been looking for security, how it would defends our people even it has never done it previously. It is useless uniform group in our region and we do not need it at all, so ,therefore, it must vacate POK region as soon as possible. POK people would not tolerate its activities in the region and it has been harming our national interests in the region and it is a danger for our reunification of the state. Pakistan army must end its occupation of its controlled territory of Kashmir region. .
The leaders alleged in statement that activists have been harassed by members of the Pakistan,s notorious state secret agency ISI in POK area. It is highly condemnable act that ISI agents have been collecting information of JK NAP local party officials and Senior leadership including JK NAP president Liaqat Hayyat. It is an harassment policy of Pakistani state secret agencies in POK and they have been trying to disrupt the peaceful struggle in POK area. ISI members have been so much hostile towards JK NAP activists since so long because JK NAP activists have not been accepting their unjustified, brutal oppression in POK. JK NAP leaders have been put behind the bar only for speaking the truth against Pakistani state oppression against Kashmiri people under their occupation.

Jammu Kashmir National Awami party president Liaqat Hayyat condemned ISI agents collecting information and making lists of our local activists, especially in District Rawalakot area. JK NAP president also condemned the suicide attacks in the area and said that it is conspiracy of Pakistani state secret agencies to make this POK area their battleground but we do not let them use suicide attacks against local national liberation movement. It would not be possible for ISI and Pakistani military establishment to crush this rights movement because people are now very much aware of their rights and will defend this National liberation movement against Pakistani occupation. JK NAP president also condemned the ISI illegal and criminal activities in POK area. Liaqat Hayyat told in press conference that ISI members are trying interfere with local administration,s work and harass them doing their duties. The similar incident has occurred in Hajira police station after suicide bombers have struck twice in this region and local administration have been trying to make lists of non locals residing in the state jurisdiction. Hajira police station in charge or Head of the police station Raja Pervez Hamid prepared non state residents lists which was ordered by AJK Govt as there are more suicide attempts have been expected by local administration, so that they are trying to take precautionary measures to prevent them but ISI agents have entered in to the Hajira police station and asked SHO Raja Pervez Hamid why he is preparing lists of non state people and they try to get the names of the listed people most of them are Pakistanis of course. SHO Raja pervez Hamid refused to comply with their unjustified unconstitutional interference with his work and fight broke out in the police station and SHO Raja Pervez Hamid arrested all of them and some were beaten up by brave members of local Kashmiri police. Later ISI alerted higher ups and SP of Poonch district was ordered by GHQ bosses that SHO Raja Pervez Hamid must be suspended immediately and SP did what ever he was told to do.

If our peaceful activists and leaders are not safe in POK there would be any one safe in this region and there should not be any doubts in Pakistani military establishment,s mind, as they have already attempted to provoke JK NAP activists and very well aware of the strength and its street power but we do believe in peaceful struggle and will continue our national liberation movement in POK no matter what it takes.

The current conspiracies surrounding the bombings in India and Pakistan are now being reenacted in POK as well. These lowly acts are nothing else but the work of Pakistan and Indian Agencies who are trying to pin it on NSF and NAP members. As a dedicated member of JKNAP I would like to highlight a few facts about these agencies. Due to the low level of intellect (due to their education standard) Indian and especially Pakistani agency members are not able to broaden their minds and hence have lowly and narrow minded views on others. They have mistreated and defied justice for innocent Kashmiri's for a very long time. I would just like to shed light for these such misguided individuals and Parties on what out real feelings are about the current situations.

Firstly and foremost I would like to deeply comprehend and condemn the atrocious acts of violence which are taking place in Pakistan and India. We deem these acts as cowardly and inhumane. They are targeting innocent civilians and are the doing of Pakistan and Indian agencies alone. The individuals and party's which are working for Indian and Pakistani agencies are the ones who need to be the prime focus when searching for the culprits. They are being used by Pakistan and Indian agencies to carry out such acts to defame each other and create disunity. Kashmir people have no links with such acts of violence.

JKNAP has been firm on its aim since its formation and that is for the Independence of Kashmir from both India and Pakistan. Although these two countries will stoop very low to reach their targets we do not operate in the same way. We are honest and open about our agenda, unlike Pakistan and India who talk about benefits of the Kashmiri people but actually are riping Kashmir to pieces. Party's such as NSF and NAP have always stood up to the atrocities inflicted by these two countries ESPECIALLY Pakistan but do not feel the need to kill innocent people in order to convey their message. These two parties have been funded by members of the party who are common residents of Kahsmir. SO the financial position of these party's becomes obvious. There is barely enough funding to keep the party's afloat hence not making them to be in a position to fund acts of violence. The people who are targeting innocent Kashimiri people and trying to pin these acts on them need to look closely at the people working for each others agencies.

These two countries have not offered us much, but are depriving their own people of basic rights. Countries which spend 80% of their budget on defence for the country and are still not able to defend it need to be ashamed of themselves. People are unemployed and unable to afford the basic amenities for themselves and the countries are unable to prevent that which they are spending most of their budget on. We feel the common residents of these two countries are being mistreated as well by their leaders. We want both countries to withdraw their armies from Kashmir.

When such acts happen they blame each other for plotting them. But now the focus is being shifted on to NSF and NAP members who are not linked in any way to these acts. Pakistan's presence in POK is causing tension. Militants trained by Pakistani agencies have been amongst the common folk of Kashmir. They have caused problems for years and instead of tackling them, the blame is being pinned on innocent NAP and NSF members. The Honourable Late Maqbool Butt Saab was tossed between Pakistan and India as being each others agent. The truth was he was a true Kashmiri and wanted an Independent Kashmir. We are the followers of the same individual and do not believe in killing of innocent people and do not wish to used as scapegoats by the larger culprits. These two countries need to look at the mess they have created and try to resolve it not to drag Kashmir through the same dirt.

International Council Jammu Kashmir National Awami Party ( IC JKNAP) leaders are demanding that Pakistani state must immediately move out its troops from populated areas of POK as soon as possible, after series of suicide attempts have been made on them. It is quiet clear that army has split in groups and fighting has been broke out among army groups and we do not want this hostile army to stay here in our peaceful region to harm our innocent people who are already victims of this occupied army. We demand that in first phase army should immediately relocate and second phase Pakistan army can leave this part of Kashmir, as soon as local Kashmir army could be restored and takes over the responsibilities of the region. Azad Kashmir army must be immediately restored without wasting any more time. It is the need of time and Pakistani army has completely failed to get even a little support from local population nor local people have accepted this army as their own. International Council JK NAP has long time ago predicted that Pakistani army and its secret agencies have been preparing ground for launching an assault on Nationalist movement that is why we have seen a series of suicide bombing in POK cities. It is an attempt to dislodge the local groups which are not ready to accept Pakistani version of Kashmir solution and JK NAP and JK NSF have been on the hit list of ISI and army establishment because they have refused to accept Indian and Pakistani secret dialog in the name of so called composite dialog and track 2 diplomacy.

Pakistani army,s presence in POK has neither been safe for them nor for our local population any more. Pakistani army has created terrorist menace in the region and imported in to the POK area and we do not accept it no matter what Pakistani army is trying to show to local people. It is highly condemnable that this terrorist business has injected in to our area. It is related to Pakistani army no one owns this business except Pak army. Unfortunately, Pakistani army has created these inhuman, ruthless religious terrorist groups and using it against political forces and now army,s pro religious group has been using these groups against each other. These terrorists are sponsored by army and we condemn this ruthless secret state policy against innocent people of Pakistan and now Kashmiris are the victims of this ruthlessness. If Pakistani army is not safe in POK and itself has been looking for security, how it would defends our people even it has never done it previously. It is useless uniform group in our region and we do not need it at all, so ,therefore, it must vacate POK region as soon as possible. POK people would not tolerate its activities in the region and it has been harming our national interests in the region and it is a danger for our reunification of the state. Pakistan army must end its occupation of its controlled territory of Kashmir region.

At the same day JKNAP & JK.NSF held a protest against load shading, unemployment and growing terrorism in Kashmir and focusing on the historical reason behind this terrorist culture which was promoted by the state since mid 70s.

JKNSF and JKNAP held protest against the Dearness, Load Shedding and evacuation of foreigners from Kashmir thorough out the whole (POK) on 15th of Jan 2010. A rally was organized in Muzaffarabad under the lead of President JKNSF Raja Saba while in Rawlakot the President of JKNAP Liaquat Hayyat Khan was leading the Rally against the Dearness, load shedding and the evacuation of Foreigners from Kashmir.
